Guest Posted September 23, 2016 Report Share Posted September 23, 2016 Hello Previously my spouse was on H1 and had an employer and used to be on their payroll on W2. Now she has H4 EAD. She got a new contract job through a vendor at a client place. Vendor is asking if she wants to be on their W2 or 1099. I am aware of W2. I am trying to look online about the differences and it looks like 1099 has many restrictions. Questions: 1. Can she be on 1099? 2. Also, would there be a salary difference from vendor on W2 or 1099? Can we ask more for any of those? 3. Which is legally correct for of employment and which provides more advantage. Thanks Link to comment
JoeF Posted September 23, 2016 Report Share Posted September 23, 2016 With a 1099, she would be self-employed. She would have to pay the appropriate taxes for that. A W2 means the person is employed by some company, and not self-employed. With a 1099, there is no salary. The self-employed person runs a business, and writes invoices. Since you don't seem to have any knowledge of how being self-employed works, it is probably safer to be working as employee on W2. Link to comment
