JoeF Posted September 7, 2016 Report Share Posted September 7, 2016 There is no "non-profit H1." There are H1s for certain organizations that are cap-exempt. This isn't for all non-profit organizations. It is only for non-profit organizations affiliated with universities, non-profit research organizations, and government research organizations. And of course, a qualified person, no matter in which status currently, can get a cap-exempt H1 for an organization that falls into one of these categories. Link to comment

If I understand your response correctly, if a potential cap-exempt employer offers a job to F2 visa holder, he can start working on it once visa is approved. There is no travel and stamping required before one can start work ? Link to comment
pontevecchio Posted September 14, 2016 Report Share Posted September 14, 2016 The F2 person can work after a non cap subject H1 petition with COS from F2 is approved. VISAS are an entry stamp only obtainable abroad and not related to your ability to work. Link to comment
