I have Approved I-140 from employer A and my wife has approved H4 EAD which is valid till 2018.2. After that if I join employer B and employer A withdraw (not revoked) my Approved I-140.3. Will the approved H4 EAD will be valid till the approved date or it will be immediately get invalid because I-140 withdrawn by employer A ? 4. If I transfer to new employer B, do I need to file new H4 EAD application along H1,H4 Transfer? Link to comment
pontevecchio Posted August 24, 2016 Report Share Posted August 24, 2016 WITHDRAWAL = REVOCATION. As long as you have an approved non revoked I-140 with ANY employer and remain in valid H1 status she can use her current EAD. I would also think an existing H4 EAD would be valid till expiry even were the I-140 to be revoked subsequently. Link to comment
