Visa Stamping after i-140 approved

Recommended Posts

Hi, i recently got my i-140 approved few months back and our current h1 has expired. Now my wife has to go to India, what do we need to do? Does she needs to go through appointment and visa stamping in Delhi? Do I need to be there as well?

When you say your h1 has expired, do you mean your visa stamp on passport or I-94?  If it is visa stamp on passport then yes your wife needs to go for stamping, again I believe you have a valid I-797 A. Having an I-140 doesn't change anything with respect to this.  You don't need to accompany her.

Note: This is my opinion and not a legal advice.

Since your H1b visa stamp is expired. You (/your wife) need to go for re-stamping while coming back to USA. Now as far as visa interview venue is concern : could be India (i.e delhi in ur case) or any other country ( Canada is very popular). You wife can attend the visa interview individually, you need not be with her.
