  1. Hello , I got my EAD and my 485 interview is to be scheduled as per the rep I spoke to today. I was looking thru' all the previous details today and just realized that I may be out of status for a period of Feb 4th 2007 to May 17th 2007. I switched between employers due to a miscommunication but ended up going back to the old one. I don't know if I was out of status at all coz my h1 got approved with I-94 with the old employer after he revoked it on Jan18th 2017. And the Approval of H1 was 07/23 but receipt date was May 17,2017,. but just prepare if this is case so I thought of checking on this. MY question here is : 1. Would the Officer look at the out of status which was back in 2017 to decide whether to approve my 485 ? 2. Are there any options to take care of this that would help me during the interview ?

    Change of Status Issues

    Hello, I do have a quick question: I am in the process of getting my 485(AOS) interview scheduled. I was going thru' my past h1b copies and found that I may be out of status from Feb 8,2007 to May 18,2007. And also I was working with the same company which may have suddenly closed somewhere in 2008 and left to my home country for good in APR, 2009 and came back in SEP 13, 2011 . Do you think I am out of status and will be denied 485 ?

    Preparing for a Current Priority Date

    My PERM was filed with my current employer address(working with the same employer from the past 8yrs) as a working location but I have never worked in that state so far. I have my PERM and 140 approved and now my priority date is current now .I discussed about 485 filing with my employer and he mentioned that I may have to re-apply PERM with current location since the initial PERM was applied using employer address which may be an issue during later stages of immigration. .Before filing 485 ,Do I need to Amend my already approved PERM which is under my employer's location now and re-apply using the current working location ? What other options do I have to move ahead with the current PERM and what is the best one to go with ?

    Employer Moved to different state during PERM Process

    I am in a similar situation as yours. My PERM was applied with my employer address as working location but I have never worked in that state so far.     my EB2 priority date is current and when I reached out to my employer for filing 485, my employer mentioned that we will have to file amendment t to be on the safe side. He was saying that the new administration introduced some new labor rules which may be an issue when I am at Green Card stage and may get an RFE .And since my labor was applied in 2015 , he mentioned that it is better to apply a new PERM and I can use the previously approved 140 priority date. This new PERM is just to avoid the new administration labor rules as per him.. Is there anything like this.. ? Any advise on this ?

    EB3 - PERM/140 Amendment

    Hello , I have my priority date in EB3 April 2012. I spoke to my employer and he mentioned that the attorney suggested that I should be filing for LABOR and PERM. He also mentioned that he can do the 140 and 485 in parallel but he has to file a new LABOUR /PERM. He mentioned that I can have the priority date but is it not the usual process where you file for Labor and PERM and then wait for your date to get current.. I am not understanding why I should be filing for new 140 and Labor.. Is it advisable ? How far is this correct when you have your 140 and labor filed back in 2012 and filing again LABOUR/PERM just to avoid any RFEs when processing 485 process ? The reason for filing a new Labour and 140 he mentioned is to take care of some amendments that were introduced in 2016/2017.. Is this statement correct ? Can you please advise details.

I applied for my PERM in the month of MARCH-2013 , My PERM got denied couple of weeks back and my employer opened an MTR for the PERM case, My 6th year on h1b will expire in JAN 2015, EMployer said that he applied for a 1-year H1B EXtension based on the 365 day PERM. My question here is : 1. Can my employer actually apply for a H1B and if he can apply how sooner will he has to apply for an extension? He actually applied for my H1B last week. Please help me, Appreciate you response in this matter. THanks in advance.

    Rahul, I am very sure something is wrong, I have a another question.. 1. I will be done with my H1 6th yr in Jan 2015 , EMployer said he applied for a 1yr extension based on the 365 day criteria, Do you have any idea about this...? I am not worried about my PERM now...I just want to be in a valid status after JAN 2015. Do you think the H1 Extension based on the 365 day criteria is a valid scenario.

    Even I found it very odd to not send a letter related to a company not on a letter head but on some white paper, In the meantime I have a question regd. the status. 1. Since my H1b is to expire in JAN 2015( 6th year ), My employer told me that he applied for an extension based on 365 day criteria for PERM, What are my chances of approval for this H1.?

    My employer told me that he applied for an extension(I got the h1 filing document from my employer ) based out of the 365days PERM criteria.. My 6th year will expire in JAN 2015, Do you think this is valid..? And will my H1 be approved while my case is under MTR as stated by my employer.

    Rahul, That is the reason my employer gave me when I asked him the denial reason, and he said that he applied for H1b Extension which is due to expire in Jan2015.(6th yr) Do you think this is a Valid scenario...Please help me..
