  1. Hi, Sorry if this question is already answered, need some help. I became US Citizen in Sep'2015 with US passport. My younger brother came to USA on H1B visa in 2017 Apr. His employer is not ready to file GC. Can I go ahead and file family based GC for my brother? If yes, what about his wife and 8 year old kid? Can I add them in my application too? What form I need to use for filing family based GC for my brother. Thanks in advance for reading my question as well as answering Regards, Swamy

    Droping lawyer from G.28 form

    Thanks for teh reply JoeF. The replacement G.28 allows replacing new lawyer. I do not want to have any lawyer on my file. How can we achive this? Is it possible to file blank G.28 form with my personal details. -Swamy
  3. Hope this question was posted earlier, need some guidance. I was with Company A(California) and using Lawyer-1. Now I am with Company-B(Boston), and do not want to use any lawyer. My EB-3 is long way to go. For authorizing the lawyer to represent a case, we file G.28. What form needs to be put for removing lawyer from representing my case? Appreciate quick reply.. -Swamy

    EB1(c)...self file 485 after i140 approval.

    You need employer blessing for filing i-485. Remember GC is for future job. When there is RFI, employer may need to issue a letter confirming the employment availability. -Sam

    My current Visa Status

    EAD is not a recognised status for bank loan. If you contact bank directly they may not honor for home loan. Better get the loan from agents or fundings, it will be little higher percent like .5%. After 6 months refinance happily and go for lower interest. I did the same way..

    Here is my observation, and it is pretty consistent. There is a trend in GC approvals like EB-2 means 5year time, and EB-3 means 10year time from Labor priroity date. If you look back, since 2005 it is going on. EB-3 with priority 2003 are getting GC in 2013, 2004 will get in 2014, 2005 in 2015. EB-2 with priority 2008 are getting GC in 2013, 2009 will get in 2014, 2010 in 2015. -Swamy

    All Govt of India employees are eligible for white passport(which is different from regular citizen passport). Hence govt does not support the people to fly out with white passport unless it is a for govt purpose.
  9. EB waiting people like us when granted GC, kids will become derivative for GC. Illegal kids has no legal status, where as EB waiting kids are in legal status and they do have valid VISA. Based on their legal statsu EB waiting kids can join college. Depending on the parents income EB waiting kids may qualify for FASA(I doubt any H or L visa holders will qualify for this). In summary EB waiting kids has no issue at all.
  10. Before USCIS fix the legally entered GC cases, there is an immediate need to fix the illegally enetred kids status. Parents might have came here illegally, that should not punish innocent kids who are turning 18years and suffer for their education. Congress has to fix this at high priority, later consider the GC for legally entered people. I do understand the wait time is long for legally enetered GC cases, but GC will come one day or the other. If we think of kids, they have no hopes nor they have no valid legal status, which will be a bigger and serious issue for schooling. -Swamy
  11. There should be another clause in bill like those who are above 40years of age must be granted permanant residency immediately. As such at 40yrs people have finished their half of life, atleast rest half be an happy ending.
  12. I would recommend signing the agreement with a fixed contract breach amount to cover the legal expenses..say $15K. It will be prorated for every month of your service after you receive GC. This is easy way to get rid off. That is the best approach and make sure they file GC and get the card in hand.

    30 day jobless - EAD valid

    My brother-in-law got laid off on 30Jun2011. Till date he has no job. He in in EB3, AOS was filed in Aug'2007. He has valid EAD and AP. Is there a mandatory requirement (like in H1B), that he has to be in job within 30 days? I was told by one of my collegaue that this requirement is relaxed if you have EAD/AP. EB3 PD is Apr'2004 and is not current yet.. Experts, Belle, Please confirm what is the exact requirement.
