    I hope you understand that EB1C is for an international manager that a company needs for genuine reasons? It is people like you who are finding loopholes in the system to abuse it. What kind of employer do you have who is ready to bend rules anyways? If not a genuine application, it won't be that difficult to find issues with your case. Your safe bet is to follow the correct path and apply via EB2.
  3. Hi all, I hope someone can answer this question. I started my current job around 3 months back and persuaded my employer to start the H1B process. After much deliberation they started the process 1 month back. In the meantime, I realised that I dont like my work and started looking for a new job. I got an offer for the new job and now came to know that my LCA for my current employer got approved. I have two questions: 1. The position I currently hold is not very valuable in market and I did not want any prospective employer to ask me why I was looking for a new position just 3months after starting in my current position. Also, the work I currently do would not have helped me much in presenting my skills for a potential new job. Hence, I did not include my current position of 3 months in my resume. Now that I have got an offer and I am planning to leave current job, I have one concern. Will there be an issue in the background check(employment verification process) since i did not include my current job of 3 months on my resume due to reasons above.(please note that I have included on my resume all the other positions i held before this current job) 2. Since I am planning to leave my current job, is there anything I need to do since the LCA for this job was approved, if I ask my current employer not to file H1B anymore since I am leaving them? Thanks a lot for your help.

    OPT to H1-B!!!!

    Hi all, I am currently on OPT since Feb 2012. My employer is going to file my H1-B soon. What I want to know is if my OPT status changes immediately into something else after the H1-B application is submitted or does it change after the H1-B is approved to an H1-B visa? If the H1-B application is not approved, what is my status here in the US since my OPT is till Feb 2013 and I also am eligible for the STEM extension. thanks.
  6. Hi, So, i am working for a cap-exempt employer(A) as full-time. I got an offer from cap-non exempt employer(B). Company B wants me to start ASAP so they filed for a concurrent H1B which in the form says to be counted under cap-exempt category from 30 september 2011 - 30 september 2014. Now, company B told me that they are in the process to file an amendment of this concurrent H1B to make me full time with them and they will be filing this amendment on October 1st 2011 which is my start date but it is a sunday (but will get the LCA approved for full time before that). So they asked me to start full time with them from October 3rd 2011. My questions are: 1. Since my start date is from october 1st 2011, can i join company B after filing an amendment of the concurrent H1B(which has option of numerical limitation as CAP-exempt) to make the hours from part-time to full time and count me under CAP, just having an approved LCA for full time with them?
