  1. Hello sb1, what did you do? Did your I140 get approved or what did you do? Iam in the same boat..My H1 B is going to expire in May 2013...still now I 140 is not approved...waiting for the approval..So please let me know.. Thanks DKPK
  2. Thank you very much for your reply. My case is usnder EB2 NIW...I did'nt file PERM (Permanent Labor Certification) and also there is no premium processing in this category. I directly filed I-140 under Advanced degree or exceptional ability requesting a National Interest Waiver Exactly i can tell that my I 40 receipt notice date is May 30 2012 and my H1B 6th year extension is expiring on June 09 2013...In this case is it possible to file for one year extension based on the pending I-140 application. If so when it can be filed...do i have to wait until May 30 2013 and then file for H!B extension...will i have time to file H1 B extension even in premium processing Thanks DKPK
  3. Hello, I have filed I-140 under EB2 NIW in May 2012. My I-140 application is still in initial review as of FEB 2013. Iam completing my 6th year on H1b in May 2013. In this case..if i dont have an approved I-140, is it possible to extend my h1b visa for the 7th year or in any other work authorization visa like O1... Please help me with this. It is really stressful..What should I plan for? Should i make my mind and make plans to move to India or is there any other ways to extend the visa to stay in US and continue my JOB? Thanks DKPK

In the USCIS website it states, IMPORTANT: If your receipt notice date is earlier then the processing date shown, we suggest you call our USCIS Customer Service Office at 1-800-375-5283 for assistance. For Nebraska Service center, the current processing date for I 140 Advanced degree or exceptional ability requesting a National Interest Waiver is June 16th 2012. But my receipt notice date is May 30 2012 which is earlier than processing date...My status still shows INITIAL REVIEW What does this mean? Is there any problem with my case? It is really eating my brain...please help me with this. Thanks. DKPK

  7. Hello, I live in US on H4 visa for the past 51/2 years. My sixth year visa is ending in June 09 2013. Iam travelling to India in May and would like to return in the month of July. My husband is not travelling so he will be applying I-129 H-1B - Specialty occupation - Extension of stay in the U.S. based on I140 approval. In this case what should i do? Will I have to apply for new H4 visa to travel back to US? Please let me know the procedure. Thanks DKPK
