  1. While i was preparing the AC21 letter last week, I came to know the the 485 application has been denied. not sure yet the reason for the revoke as i haven't gotten the notice yet. could somebody please advise: 1. can i go to work once we receive the denial notice? let's say, if i am going to receive on Monday in the mail, can i still go to work on Monday or after that? 2. what would be my status once i file motion to reconsider? 3. how long i can be US on legal status? 4. can my previous employer or current be able to file H1B on approved Labor certificate (approved 140 has been withdrawn, not on fraud basis though). 5. what are my options to continue on legal status?   2. Thanks Joef. I am getting a better lawyer now. The reason i had agreed to the current lawyer that AC21 is optional so didn't go ahead and file at after leaving the previous employer. do you think, it would be fine by properly sending AC21 now.
  3. Kindly advise, is it possible to reinstate the I-140 by the previous employer, if it was mistakenly revoked. thanks.
  4. Thanks pontevecchio. I just received the case alert on i-140. Not sure what was the cause to revoke the i-140. " we automatically revoked your Form I140, IMMIGRANT PETITION FOR ALIEN WORKER ". this is part the email alert i have received.
  5. Thanks for your reply Joef. For some reason my attorney suggested, wait till if i receive any RFE. Filing Ac21 might make USCIS to issue RFE for some other information about the new employer.
  6. Hi, this question might have been asked before, but didn't find good information on internet forums. My priority date December 2009, EB2, filed 485 in Feb 2012 and got EAD/AP and renewed it multiple times. I had changed my employer in Dec 2013 and started working fulltime for another employer on EAD. last week i have received a notification on my i-140 case that it has been removed automatically. I haven't filed AC21 when i had changed my employer. Could somebody kindly advise, what are consequences for revoking i-140 on pending 485 and what are the steps i have to take now. Thanks.
  7. Hi, My mother-in-law is travelling from Atlanta to Hyderabad, through Paris and Mumbai on Aug 10th, DELTA 8517, DELTA 8705 and DELTA 7554.     B2 Visa for In-law's

    Me and My Wife currently are on GC-EAD and both are working fulltime. We are planning to send my In-laws for B2 visa.My wife has one sibling (younger brother) who is in Australia. were there any cases of VISA being rejected if both children are out side of india. my father-in-law's parent still live in India and they have agriculture and residential properties to show there bond with the home country. Please advise.
  9. Thanks very much Belle. that's exactly what my lawyer told me. also, the new company said, they hired people on EAD before and they have immigration dept, will answer any job related queries. I am keeping my fingers crossed and hoping they will more flxible once i join them.
  10. Hi, I am working on GC-EAD got under EB2 and 485 has been in pending since Feb 9th 2012. I am interested in moving to a new emoplyer on Full time opportunity. but the new employer's offer letter has job title which is same to my PERM position and job duties also same but offer letter doesn't have job duties mentioned on it and also, it has 37.5 hrs per week as their current policy. can i use this offer letter to file AC21. does it considered not full time if they mention "37.5 hrs per week as their current practice". I have asked the HR to see if they can remove the Hrs section but they say, it is their standard format they can't change it, but they are ready to answer any queries from USCIS if i get any. My lawyer says, it's not a good idea to file AC21 with this offer letter that may let USCIS ask more questions, in stead, if they issue any RFE, then we will answer that, also at that time employer may give EVL which may be in different format than the offer letter. here is part of the offer letter: We have agreed to a semimonthly salary rate of $XXXX which annualizes to $XXXX. You will be paid on the 15th and last day of the month, or the business day prior if it falls on a weekend or holiday. Under current practices, our normal work week is 37.5 hours (1950 hours per year), and employees are paid pro rata twice per month with a total of twenty-four pay periods in a full year cycle. In addition to your compensation, the Firm provides excellent benefits package, including PTO benefits. kindly advise. thanks a lot.

They have the full job description but not added to offer letter. they are okay to give as an attachment. but coming to 37.5 hrs, my lawyer said, it's not good to send that letter to USCIS part of AC21. lawyer said, we will ask them to give employment verification letter if we get an RFE.   12. They are not ready to change the letter format as it is their standard. also says that, 37.5 is not considered as part time job by FLSA standards. is there any go around or how to proceed on this. thanks

Hi, I am interested in moving to a new employer. they offered me a full time job but their offer letter has no job duties mentioned except the job title and their policy is 37.5 workhours per week which is mentioned in the offer letter. I am working on GC-EAD under EB2. can I send offer letter with 37.5 hrs per week and with no job duties mentioned along with my AC21? Kindly, please advise. thanks
