I have to appear for stamping in then next couple of weeks in Canada. I got my H1B visa extended in May for 2013. I had then for a client letter in a proper format which I used in the extension petition.(The client letter was dated April 29, 2013) I approached the client for a letter again today, and they have said that they do not provide any letter now for Visa Stamping. Also, I am unable to get an email stating this denial, since they do not want any into any legal aspect if at all. I am surprised that things in the company change so quick, I had no difficulties whatsoever to get the letter a few months back. Can I use the old letter which will be about 5 months old when I go for stamping ? I am in EVC model and have been working for the client for last one year. Any suggestions or recommendations would be helpful. I do have all the other relevant documentation(pay stubs, w2, vendor letter etc.) Appreciate your responses.

My friend and myself both on H1B, are planning to buy an existing retail business. There would be a manager who would take care of day to day business. Since we already have jobs, we would not work for the business. Is this setup feasible ? At the end of the year if there are any profits/losses, are we entitled to those ? Any implication on our GC processing ? Thanks

Hi, If I140 is denied for a specific reason, can it be refiled after correcting the reasons ? or a refile is not possible ? I know that an appeal can be done, but wanted to know if I140 application can be filed again ?

Thanks for your reply... If I take into account the recapture time, I think PERM was filed a few days before the start of my 6th year... I just noticed , that your priority date is same as mine.

Thankyou, Sameer, so based on only approved labor certification, we cannot get H1b extension beyond 6 years, For extension of H1 beyond 6 yrs, I140 should be approved. is this understanding correct ?

My current H1B is valid until Jul 2011, and I have 6 more months(taking into account recapture time) left of the total 6years quota. My labor got certified a couple of days back, My question is for how long can I apply the H1B extension now ? Since my labor is certified , can I seek a 12 months + 6 months(from the existing 6 years quote) = 18months extension ? or will I be eligible for only 6 months of extension. Even if I do premium processing, I don;t think I am ample time for getting I140 approval
