    Problems at Port of Entry ?

    Are there any entry experiences regarding passport holders from countries "not on the ban list" with H1B, Green Card, born outside but now US citizens ? I have GC with passport from country that is not on the ban list. Planning to go to Mexico for vacation in March. Is it advised to continue with the plan?

  3. Hello, I am going to consult a proper lawyer for this case but I am posting to this forum thinking there may be similar cases. I have been living in the US from past 13 years all good standing and 4 years back received green card through EB1 (Researcher). Now we are close to qualify for citizenship application and one unforseen problem has arised. A police case was filed on my wife by her ex-sister-in-law (brother-in-law's ex-wife) in India. My first question is-is it required to disclose this in citizenship application for my wife? The police case is a bogus case but it has to take course of law to be judged in court. With Indian law system it may take years to resolve so it is advised to only apply for citizenship when the whole matter is cleared? Any experiences with this type situations are very helpful for already tormented us :).

    Continuous stay requirements

    Hello members, I am currently working in a fortune 500 and have green card. My wife is also on green card and is a stay home mom. Recently I was asked if I am interested in working for similar position (senior engineer) in the UK. I am not sure how this is going to work for our citizenship stay requirements. We both got GCs 1.5 year back and so there are still 3.5 more years of continuous stay required to qualify for citizenship application. I heard from a friend this weekend that it is possible to work in foreign country and still qualify for citizenship stay requirement. I have never heard this before so wondering if this is true. If so is there any limit on # of years I could be gone ? What happens to my wife's citizenship requirements since she most likely will be stay home mom. Your suggestions are highly appreciated.

    Minimum out of the US stay requirement?

    How many visits are considered frequent as per USCIS? Its only their second visit isn't it and this may be the last in next 2-3 years.
  6. Dear experts I have this questions regarding visitors visa. My in-laws are currently in the US since July 2013. They are granted approximate 6 months of stay as per their I-94. So their return is planned for January 2014. Now my questions is if they want to come back to the US again in March or April 2014 is this violating any visitor's visa laws. Or will it count as exploitation of this visa category by any means ? I am told by some people that they need to stay out of the US for at least the same amount of time they spent in the US. I know for sure that there is no such law but has anyone seen any issues while entering the US due to this ? You replies are greatly appreciated. If you have real experiences please do mention that.

    Visitor visa for mother in-law

    Just to add more information which I forgot in OP: I am in the US from last 10 years. Currently on GC. Wife in the US from last 4 years she is also on GC. I have full time non-IT job.
  9. Hi, We want to invite my mother in-law to the US for house warming. My father in-law has applied for passport but with the changes in passport services his passport is stuck in processing from last 6 months or so. We are not sure how many months we will have to wait for passport for father in-law. I am wondering if it is safe to schedule visa interview for only my mother in-law? She already has the passport and all our paper work is in order. We will plan for father in-law's visa interview when his passport arrives. Are there any risks of denial in such case? Or should we wait until his passport arrives and schedule the interview together ? Any experiences, thoughts, suggestions will be very halpful :)

Dear all here is the timeline for my (& wife's) GC process I-140 Receipt Date: Feb 16, 2012 under EB1 at TSC I-140 Approved (Priority date): Feb 28, 2012 I-131, I-765 & I-485 Receipt Date: June 22, 2012 at TSC Biometrics Appt: July 23, 2012 Received EDA and AP: August 1st, 2012. Now when I check status of application for I-485 it still says "Acceptance". It says on USCIS website that this step takes 2 days, so why is the status not updated yet ? The TSC recommended time to process I-485 is not updated since May 31st, 2012 so I have no idea which filing date they are processing currently. Is anyone in similar situation ? I am not worried but its always good to know the timelines for similar applicants from TSC.

    My lawyer received the EAD on Thursday, August 1st. Also received the email update from USCIS saying it was delivered to address on file.

    I received another update today morning from USCIS for I-765 now the online status is changed to "Post Decision Activity". I wonder what is going on ? Why the status will change from Card Production to Post Decision Activity ?

Dear all here is the timeline for my (& wife's) GC process I-140 Receipt Date: Feb 16, 2012 under EB1 at TSC I-140 Approved (Priority date): Feb 28, 2012 I-131, I-765 & I-485 Receipt Date: June 22, 2012 at TSC Biometrics Appt: July 23, 2012 I-765 USCIS Case Status Updated to Card/ Document Production on July 27, 2012 I-131 USCIS Case Status Updated to Post Decision Activity on July 27, 2012 Now my questions are : 1) There is still one more case status update before EAD card is mailed to me, is this correct ? I could not see any status showing "card shipped/mailed" as a standard on USCIS website. One would expect that USCIS give a short description of all the case status updates used but seems like they don't care (why should they right ?) and are not consistent. 2) When should I expect the EAD card ? 3) Is there way I can track the shipment by calling USCIS and getting tracking number ? 4) When should I expect I-765 approval ? and final GC ? 5) I am planning to make a short international trip at the end of November, I do have valid visa stamp until March 2013. Are there any issues I should be aware of before I decide to go on this trip ? Your replies will be appreciated !!!
