    Discrepancies in Birth Records

    Hi, My birth place (city name) is not matching between the passport and the birth certificate. Both places are in same state though. We filed I-485 and indicated the birth place in the forms as same as my birth certificate. Does it cause any issues because my passport has a different city name? Do you recommend me to apply for correction in the passport before I go for AOS interview? Thanks.

    I-485 validity?

    I am in confused situation and appreciate any thoughts. Aug 2016- I-140 filed under EB-1b by my company, say A Dec 2016- Company went through organizational changes, merged with sister companies. Company name and EIN changed, say to B. It is not to a complete new name, just the way it was set up was changed (eg. LP to LLC etc.) June 2017- my I-140 approved, but cannot file I-485 due to retrogression in EB1 dates Oct 2017- submitted I-485 by company B based on approved I-140 from company A (remember company B is formed from merger of sister companies. My job remained same). Apr 2017 - received RFE to submit I-485J. Company B is preparing I-485J and using job portability under INA Sec 204(j). My question is - can I use job portability even though I-485 has been filed by company B? My lawyer says amendment is not necessary. Is this true? Is my I-485 valid even though technically I am not working with company A on I-485 submission date? Please note company A is merged inside company B when I am filing I-485.

  4. Hi all, Any inputs? Have anyone experienced recently that their I-485 has tranfered from TSC to NSC? Is it an indication that they are re-visiting my I-140 too? FYI, my I140 has been approved by TSC. Thanks.
  5. Hi, I have an approved EB1b and applied AOS for my family on Oct 2nd at TSC. Our I-485 cases are transferred from TSC to NSC including my I-485J and the transfer notice says the following - "We have completed a preliminary review of the application or petition listed above. As part of standard processing, we transferred your case to the USCIS office listed below that has the jurisdiction over your case. That office will notify you in writing when they make a decision on your case or if they need additional information". I am still working in the same state that TSC has jurisdiction. They didn't transfer the case for speeding up the process... so what made them to send our cases from TSC to NSC? My spouse works in a state that NSC jurisdiction and currently, his I-140 & H1b extension are pending at NSC. Does this situation have anything to do with transferring the case? Our I-765 & I-131 cases are still processing at TSC. Appreciate any inputs. Any one experienced similar message when their case transferred? Thanks.

    I applied I-485 last week based on my approved EB1b I-140 and this week I got the news that I have been part of the divested assets. Job is guaranteed with same roles and responsibilities. I have heard that if I became an official employee for the new employer before reaching 180days, I have to restar my I-140. The Successor in interest does not hold for EB1 it seems. Is that true? Just want to confirm. Thanks.

    Date of filing vs final action date

    I am in the same boat as yours. My lawyer informed me that we cannot submit AOS in July as USCIS specifically indicated in the bulletin that for July, submit AOS only by following final action dates. Either we have to wait until the final action dates becomes current or when USCIS accepts AOS based on filing dates in the following months. Need to wait for August bulletin!

    Thank you for your reply. This means, if the successor of interest willing to take over my immigration responsibilities, they new employer don't need to submit a new I-140, only need to provide an employment verification letter that goes with my AOS. Am I understanding right?
  11. Hi, My employer applied EB1-b in Aug 2016, received approval on May 31st, 2017. As the final action dates retrogressed for June and July and USCIS specifies that only final action dates need to be considered for submitting AOS in July, I cannot submit I-485 and have to wait until the dates becomes current. My company is going through some acquisitions and it is a possibility that I will be moving to a new company as part of divesting process (new employer becomes successor in interest). In this case, does the new employer need to file I-140 again? or can I directly apply AOS with new employer with the existing I-140? Thanks.

    Full time job- business travel required!

    I am not from those 7 countries that is included in the ban list. Our employer issued a clear message for the employees from those 7 countries not to travel. But for employees from other countries, they said they will provide all the legal support if any troubles arise at port of entry when traveling on business. Decision is ours....
  13. Hi, I am a PhD degree holder and working full time in a global company. I need to attend some business meetings in Europe for a week. My travel is scheduled for this weekend (hard to find alternative solutions in the last minute). I have all valid documents and I am on H1b. With all the speculations going, everyone recommends to avoid travel during this time. But I am in a tough situation as if I cannot travel, it impacts the project outcome. So I am not sure how to communicate this with my employer. Will I be at risk if I travel? Also more speculations going on that executive orders may come for H1b reform as well..... Thanks.

  15. Hi all, I am full time researcher with a multi-national company. Due to recent changes in our organization, the company name has been changed effective Jan 1, 2017. Our law group filed amendment and petition is currently in processing stage. I need to travel to Germany for business meeting in February. I already have valid H1b visa until Sept 2017. Can I enter the country with my current visa with new I-797? If needed, I can get a letter from my HR stating that my job and responsibilities have not changed. Appreciate your comments. Thanks.
