  1. Hi, I am in the process of getting US citizenship (currently in the 3rd year of my GC) . I have plans to move to India or closer to India once I become US citizen, the reason being both mine and my wife's parents are aging and there is no one to take care of them. I was wondering how soon I could leave permanently for India after I receive the US passport and get the OCI card from Indian Consulate? Is there any chance to lose US citizenship if I do not return to USA for very long time say 10 years? Do we have to maintain any kind of residency proof in USA? for example, maintain bank accounts, file taxes, etc. We do not own a house here, only other thing is I have a 401-k account with my employer. Appreciate any inputs that can help me in this matter.Thanks.

Hi All, I have a question related to a post I noticed within the News section of this site related to the changes in the Medical exam, wherein the gonnorhea testing has been added as a requirement leading to some RFE's. Me and my spouse had already completed our immigration physical and our civil surgeon handed over the sealed envelopes to us on Jul-23-2016, which is before Aug 1ST 2016. The civil surgeon did not ask for this test to be performed, so there are probably no remarks related to this on the completed form.. My question here is: Will me and my spouse have to go back to the civil surgeon for this testing ? My PD is Aug-15-2007 (EB2), already received the EAD combo cards (both me and spouse), fingerprinting complete and I-485 was filed on Nov 15th 2016. Is the Aug 1st 2016 date mentioned refering to the date of the exam or is it the date of receipt of application by the USCIS ? Appreciate any responses related to this... Thanks in advance..

    Hi, I would really appreciate if someone can provide information around this. My case has been filed as an EB-2 preference classification with the Nebraska Service Center (Employment Based, myself plus family). I-140 has already been approved, and since my I-140 from my previous employer was still valid, the previous priority date was ported (PD: 15/AUG/2007). We completed our fingerprinting on 5-JAN-2017, myself and my spouse have already received our EAD cards. The I-485 receipt date is Nov-15-2016, and the service center processing time for NSC is showing as May-02-2016. Does this mean I have to wait for 6-8 more months to get the final green card ? What's the general timeline after completion of biometrics (fingerprinting) ? Thanks and appreciate any feedback.

    H1-B visa - Travel

    Hi, My H1-B visa is expiring on Nov-30-2017. My I-485 has already been filed on Nov 18th,2016 in the EB2 category. With my priority date being current (PD: Aug-15-2007), I may most likely get my EAD cards some time around Apr-May. My question here is that I am travelling to India in Jun-Jul. Is there a restriction on the validity of the H1-B visa, as in while returning back to US in Jul 2017 does the H1-B visa need to be valid for more than 6 months or something. OR I should be able to return back without any issues with the H1 still valid for another 4 months until Nov 2017 (that way I don't have to visit the US consulate in India for stamping, etc). Appreciate if someone can respond on this.. Thanks

    US Passport/PIO Card..

    Hello, I have a question regarding my child's US passport and PIO card. My son has his old US passport endorsed on the valid PIO card (PIO card is valid until 2026). Is it okay if we show his new/current US passport and the PIO card at the Indian immigration? Appreciate if someone who has been through the same situation can respond... Thanks.

Hello, I am planning to book a ticket for travel to India via Franfurt/Munich (Germany), We wil be traveling in Jul 2017, both mine and my wife's H1B/H4 visa has been stamped and valid until November 2017. Child is US citizen. Our AOS has also been filed in first week of November. I wanted to know for this case, would we require a transit visa for the 3-4 hours of layover at the Franfurt/Munich airport ? We will not be going outside the airport. The requirement says Indian nationals with valid US visa are exceptions to transit visa. Just wanted to double check and confirm on this, appreciate a response on this matter. Thanks in advance..

  15. Hi, My LC was recently approved by my current employer. My application is being filed in the EB-2 category, also my 1-140 that was filed by my previous employer has already been approved with a priority date of Aug 2007. I have a couple of questions: a) Can the I-140/485 be concurrently filed for my case, since it looks like the priority date for EB2 is at Jul 09, which would mean my priority date is current (as my employer will port my already approved I-140) b) Should I go for premium processing with the I-140 ? I am thinking with the priority date being current and my case if filed concurrently would be handled faster than other cases. My attorney is saying that it would not make much of a difference if I go for premium processing, and I would be wasting the $1225 fee. Appreciate your inputs and suggestions..
