    Hello, Thank for starting this thread. I am in US on H1B and hold a approved 140 application. I have been hearing that with the new executive action that anyone with approved 140 can now apply for 485 to go in to EAD without having to wait for thier labor date to become current. Is that true? i do not see that information in president's transcript. If the above statement is true when is USICS going to accept application for 485 and what are the processing times going to be? Thanks

I went to stamping for H1B renewal at matamoros today but the Visa officer rejected my Visa and also stamped "Cancelled Without Prejudice" on the existing H1b visa valid till SEP12 2011.. the reason for denial is that i go my stamping on 10 jan 2010 and i enter US on 7th april 2010.. I dono what is problem with that. i had two months notice with my employer in india and then i had to do my preparations. Now i am in US with a temporary i94 card which is given based on B2 visa(i already had)it is written that i must go india within 10 days and get H1b stamped.. My employer is saying that he can pass a amendment and change the B2 to H1B..Is that a good idea? please advice experts.. thanks

    @raghuvar-thats true even my visa was denied by the same VO he went one more step to revoke my exisiting valid visa.. so i came chennai for stamping now it is approved and waiting for passport

  7. @Desperate123- they are very particular about it. there is another person who had the same reason as yours and the VO was not ready to hear. the same is updated in the site. i am not discouraging you but just letting you know. @brahmajidbr - for a similar case the VO asked about paid leave. so if you have taken more than 15 days then your employer wont be able to pay for that and you can say that as a reason but it is still up to the VO. i would say go for ottawa canada instead of matamoros if you can wait for interview.

    Thanks all. Sorry i got busy.. I am still waiting to get my passport. "Your Passport is under process at U.S Embassy/Consulate." @ajexpert- In mexico the vo officer was not interested in seeing any document after he found that i had 3 months gap to join my employer after getting stamped. So immediately told that he cannot issue visa,cancelled the existing visa(God knows why even the chennai VO doesnt have an answer)and refused my renewal with a 221G. I didnt carry anything extra to chennai consulate.My petition is never revoked @bindasbob- Ya i got a 221g for visa denial @ mexico but that doesnt say the actual reason it just says needs more administrative processing. You can tell the exact reason why your visa is refused in mexico. i would suggest you to take an attorney's advice.. @gkh- the answer in my case is Yes-visa is denied. I gave the same reason what the Visa officer told me "i had 3 months gap after getting stamped to join my employer and the VO is mexico said they cannot process it there and i have to go to india for stamping" i also gave the reason for the gap.

  10. if you ever have gaps in your employment or if you had gaps after getting stamped for the first time in india and took time to join your employer then i would strongly suggest you to drop matamors plan..

Me: ONe VO:who cancelled you visa? Me:I had gone to mexico for interview and for some reason the VO their had cancelled and he didn't give me the reason VO: what is your annual income: Me: ******$ VO:Can you give the copies of I-129 and document submitted to USCIS Me: I gave the documents VO: Can you show me your recent paystubs? Me: VO: your visa is approved and we will courier it to you in a week

    the chances of change of status is good if you have all the documents.I am in india now as I dont want to complicate things by applying for a change of status as i had to travel India by end october for a function and i will have to any way get stamped then... btw i went for stamping yesterday and it is approved..
  15. If you have all the docs you can get it stamped in chennai.. there wont be any problem.. At matamoros they were very particular about any gap in employment after visa stamping. If you had gone through the previuos discussion in the forum before your interview you might have not been in this situation.. All the best

    It is completely legal but the problem is that you should be ready to leave the country if h1B is either denied or if you receive a new H1B without i94 and you wont be able to work until the time you get your h1B approved. If you are planning for change of status then i would say do premium.

    The w2 and lca in my case was not a problem. My w2 was infact high.. I just had three months gap. Dont go matamoros if you have gap. The officers were strict, one of the officer infact asked to another guy who came with me, "did he come to matamoros thinking it will be easy and thought they won't ask for any doc.. "Btw that guy got stamping after 30 min discussion...
  18. Hi friends.. I appeared for my h1b visa renewal today at matamoros mexico. My current h1b is expiring sep 12 2011 so I thought I could apply for the renewal before it expires. I had the consulate interview today and the officer rejected my visa stating that I have gap between the date previous h1b was stamped and the date I started working for my employer. He also started that I have roi goi to india for visa stamping. I got my last h1 stamped on jan 10 2010 and I reached us on april7 2010 as I had give 2 months notice to my previous employer in india and I had some personal reasons too. Since I had a valid b2 visa the border office people gave me a new I 94 based on the b2 visa for 10 days.they also told that it is given only for me to prepare for my departure to india. So I have anu option now to stay and work in Us. My employer say that I can pass an amendment and convert the b2 to h1. And then I can go for stamping after six months. Is that going to help? I am confused please share any information you think that would help me Thanks, Prem
  19. If you have more than 2 months Gap between your Actual visa Stamp date and the date you started working for your employer. I would stongly suggest you not to go. There has been 6 rejections for the same reason in last two week. Make sure you have W2 matching or higher than LCA also be prepared to answer question like why is your salary in W2 fluctating every year..

    @Ashu_chicago - There was another guy who got denied the same day in matamoros consulate for the same reason as mine and he was asked to get stamping from india but his existing valida visa was not "cancelled" but he was interviewed by a different VO.

    1.Leave the country before the I-94 date and appear for stamping in India 2. Convert my B2 status to new H1(cannot work until approved) This is what my attorney told me. I am unable to decide upon this. Please let me know your thoughts

    Thanks for responding.. @MVSR845 - Yes i was working with my employer in India and i have the letter as proof from my empoyer in india.. My H1B was approved for 2008/2009 but because of recession i didnt go for stampung until Jan 2010. @dealguy007 - No the only question VO asked was when did i get stamped and when did i join the employer.. thats it and he asked me to show the W2. then The interview lasted only for 3-4 min.
