    Okay I may not be knowledgable like yourself with the entire process but help me understand one thing. Below is my timeline: I came here in 2003 on F1 Converted to H1 in 2005 Stamped in 2007 Wife's stamping of H4 in 2008 First extension in 2008 I140 approved in 2008 Wifes visa stamping again in 2009 My visa stamping (H1B) in 2010 Visa extension (7th year) 2011 (Full employer-employee relation proved in the extension paper work, I have the entire 200 page petition with me) Have to go for stamping in 2012 again, since I am leaving the country. All the while I have been working in EC model with the same employer. Haven't changed the employer, have been working for the same client since my last 2 extensions and stamping. How many checks do I have to go through to prove this? How many times do they need me to go through this stress every time I leave this country? How does it make sense to approve petitions and allow people to stay in US as long as they dont leave the country and only penalise people who have to go back due to some personal reasons. How much change do they expect in my case while I am working for the same employer and client in the same job since my last stamping in 2010? What are they trying to prove? I think USCIS should take more responsibility and deny applications which are shady, instead of approving them and causing further trouble. Just think about it and it will not make sense. I am just fed up. You can say leave the country if you want but it is not that easy.

    Thats true, these applications should be filtered at the approval level itself, rather than at the stamping. It does not make sense as if someone was able to prove EE while getting their petition approved they should be able to prove it during H1B stamping too. I dont see any reason why the VO should feel different than the person approving the petition. This is just a money making strategy by USCIS. The approve the H1 petition and take $150 for the visa application and then reject them later. This way they make more money thats about it. The entire process dont make sense. USCIS approves -> VO decides there is no evidence of EE -> 221 g -> after submitting the relevant docs the candidate gets stamped -> the officer at the port of entry can still send you back -------Does it make sense at all? Nope, not to me. So basically the country does not trust their own departments.

    Are I129 & I797 forms should be original?

    I129 is the petition document which is in most cases over 150 pages in itself. It normally has all the documents like the Contracts/ Employee-Employer relationship info etc. The I797 obvoiusly is just 1 page.

    I have a question though. Is there a reason you guys decided to go there without your petition documents (I-129) ? I thought that it was one of the required document for H1B stamping. I thought we need to always carry that with you.
  5. Hello all, I work for one of the Big 5 indian firm (****, *****, *****, *** etc). Has anyone been to canada for H1B stamping from one of these firms. If yes did you have to carry a client letter? I work for a client who would not provide a client letter and I am worried if I would be denied on that count. Please let me know if anyone has recent experience. Thanks.

    Yup they dont allow external links here and they dont allow to post the lawyers name either which I did. Don't quote me on it but a reputed lawyer had posted that in his forum as an advice. So I am thinking he is right but you can confirm is by probably calling the consulate itself.

  8. Yeah very intelligent, I meant 3 stamping for myself, 1 (Before 3 years completion, After my first extension, After my 7th year extention), 2 for my wife's H4 in the last 5 years. Which makes it 5 stampings over all where my credentials were scrutinized. Yes I have been pretty successful with the immigration but with changing times it is not bad to keep in touch with the different scenarios. I guess this is a public forum, I dont need to told by anyone where I should be. I could well make my own decision on which forum to post. Thanks for the advice though.

    They do not cancel visas in Canada or Mexico when you apply for a new visa - unless they issue a replacement visa first. A visa issued for a petition filed by a previous employer may still be used as long as you have a currently valid H1B petition for any employer.     Thanks vcpaturi. I got in touch with them and got the information. Does it matter if we just put tourist in the application form? Do we have to mention that we are going for stamping?
  11. There is no need to laugh. I have been to stamping in India 5 times in the last 6 years and have never faced an issue even once. Much better than the "E-V to the power n-C" companies most the people work.

I know that Detroit does not but what about New York/Buffalo? Does anyone have any recent experience of getting same day Visa? Please let me know. Thanks,
  18. Hi, I work for Big 3 company from India (E-C model in the US) in the US and have a masters here. I have attended 2 successful Visa stampings in India, the last one being in 2010 september. I am planning now to go to Canada for stamping. My client is a large insurance firm in the US and will not be providing client letter. Is it fine to attend Visa stamping without the client letter and just the Employee verification letter?

    Hi, I am planning to go to Canada and I do not have the client letter. I work in the EC model with a large Indian company. I have attended 2 successful stampings in India in the last 3 years (latest in 2010 september). I am not saying that it means anything but just letting you know. My client is a big insurance company in the US and do not provide the client letter. Will it be okay if I go for stamping with just my employer letter? I have been working with the same company for 6.5 years since the completion of my Masters in 2004. Thanks.
