  1. Hello, Iam currently working as a full time employee using my H4 ead. I dont have H1. I plan on applying for H1 this year, 2018. Is there a chance that another employer can still file my H1 this appril 2018? please share your thoughts. Thanks

Hello, As per the new final regulation published on murthy's forum (https://www.murthy.com/2016/11/23/overview-of-final-regulation-for-high-skilled-workers/) that goes into affect on Jan 17, 2017, I have couple of questions regarding the same. I have i-140 approved petition with my current employer and wife working on h4 ead and my H1b is valid till 2019. 1. If I plan to change the job and my wife revokes my i-140 (there will be no fraud or misrepresentation) will my wife H4 EAD will be valid till 2019? or 2. Does my wife has to quit the job and wait till my new employer files my gc and wait till i-140 is apprved so she can apply for EAD? Please let me know. Thx in advance.

    What often do the companies withdraw the i-140 petition for the employees that left the organization? Is this a huge task for the organization or do the companies normally don't bother about it. Thanks.

    Hello, Currently we have a 3year H1b extension and H4 EAD extension till 2019. I am working as a fulltime with approved i-140. My questions are: 1. What happens to H4 EAD if I change jobs and the new employer is not ready to file the GC. Will it be valid till 2019? 2. What exactly is revoking i-140? Does the companies normally do that if an employer quits them? Thanks in advance.
  7. Hello, I have couple of questions. 1. My parents are green card holders and they are going to take citizenship in a year or two. I am currently on H1b. My employer already started my GC process. How long will it take for GC if my parents sponsor me after they received citizenship? 2. My sister is citizenship holder as well. How long will it take for the GC if it's applied through her?     Thanks for the reply. But as per the proposed rule released in Dec 2015 (link below), 3 year extensions are possible even if the employer withdraws i-140. Is this true? Please confirm. http://www.murthy.com/2015/12/30/newsflash-proposed-rule-would-provide-improve-job-flexibility-grace-periods-and-more/ Once an I-140 has been approved for 180 days or more, the U.S. Citizenship and Immigration Services (USCIS) would not revoke the I-140 other than in cases of fraud, misrepresentation, or a few other limited situations. While the I-140 still could not be transferred to a new employer, it could nevertheless be used for purposes of extending one's H1B status beyond the 6-year limit, even if the employer requests withdrawal of the I-140.

    H1b transfer and H4 Ead validity

    Hello, I have a quick question on the H1b transfer and H4 EAD validity. Me and wife are currently working. What happens if I move to employer B and H1b is transferred to the new employer. My questions: 1. What happens to the H4 EAD. Is it still valid because h4 is also tranferred? By taking into consideration the new USCIS published in Dec 2015 , below are my questions: 2. If the Employer B doens't start the GC process immediately and my current employer revoked the i-140 petition, is the H4 EAD still valid ? 3. WHat happens to the H1b extensions, will I be getting 3 year extensions since my i-140 approved (as per new rule). 4. As per new rule, with approved i-140, priority date can be retained.     H1b Ext and H4 EAD

    Hello, My employer filed for H1b extension, H4 extension and H4 EAD in regular processing. Currently my wife is also working on H4 EAD. Both H1b and H4 EAD are valid till March 30. Now they have decided to file under premium processing, my questions are: 1. Will they process all the applications at a time or they will process only H1 since its premium and H4 and H4 ead will take the regular time? 2. Is there any grace period for H1 and H4 EAD if we don't get any responses back before march 30? Thanks in Advance.
  12. Hello, I have an approved i-140 and my wife is on H4 EAD. One question I have is: If the proposed rule is implemented what will happen to H4 EAD, if I plan on changing the jobs and the new employer hasn't started the green card process yet and my current employer hasn't revoked or withdrawn the i-140 petition. Will the H4-EAD be still valid and my wife can continue to work while I am with the new employer? Thanks in advance.
  13. Hello all, Currently I have an H4 Ead and working for a client though a vendor. What if the vendor wants to apply for H1 next year. My questions: 1. What happens if the H1 if it's approved and I plan on to continue with EAD? 2. If some reason I plan to work on H1 again after 3 years, will I be cap exempt if I am already approved next year? Please share your thoughts. Thanks.

    Hello, We got the H4 EAD approval last week and we are exploring the options as how she can work. Couple of questions. 1. Can she take up full-time/part-time? 2. Till March, she worked for a client A, with 2 sub contracting empolyers in between. Now, can he directly work for a primary vendor? because the client won't take fulltime.? Please let me know. Thanks.
