    EB5 Track & Time Frame

    I filed 4/17/2017 and received approval on 6/26/2018.
  2. Based on current timeline living in California, if priority date is current and never been out of status which option is better? Should I file for I485 which seems long average processing time vs Immigration Visa. FYI, this is based on I526 approval. Currently in California on H1B since 2009. Based on processing time for both (Consular Processing and Adjustment of Status) which is the shorter timeline?

    Yes definitely they can do it. Just need to send PP check with form filled or can do it online as well. I prefer to do it online as that is faster than paperwork. Check USCIS website and in their search box type Premium Processing. They have excellent information available there. Good Luck

    H1B cap exempt start date

    You have to wait till H1B approval and as you dont have any current work authorization you will need to wait till H1B Start or Effective Date which you will see in approval notice.

    Advice for complaint against H1B employer?

    1. Your fees to USCIS will be send after your LCA approval with I-129 petition. 2. Do you really want to chase your $2000 and bang your head against wall with all legal matters or you want to move on? If you want then start gathering all proof of your payment and contact DOL by phone or email. They will be able to guide you further process. I hope this helps. Good Luck
  6. I think if you visit outside country and come back in before your H1B effective date with valid H4 you don't need H1B visa stamp. You can come back on H4 status and start working on Oct 1st once your H1B is effective. I hope this helps. Good Luck.
  7. Approval receipt should come quick after your approval. It should not take more than couple of days. To qualify for application this time you need some short of approval proof and which is your I-797 approval notice which will be received in mail. By the time your new employer can process your LCA which will take about a week to ten days and there you can utilize your time. I hope this helps.
  8. You first have to get approval on current application as cap for this year has been reached. To avoid any risk, expedite your current file as a premium and then you will not be subject to cap and can apply for H1B from another company. As for this year there is no way company B can file H1B for you with out approval of H1B filed by company A. This is the best rout to go. Good Luck.

    H1 Transfer before Oct 1st

    Yes, definitely you can. I asked same question before few days as I am in same situation. Technically it is a new H1B applicatoin as your current approval is not yet been effective. Read post http://forum.murthy.com/index.php?/topic/40741-h1b-transfer-before-effective-date/ My new H1B application has just been approved for process so I can say DEFINITELY you can change job. Only thing is you won't be considered for CAP as CAP is already assigned to you. Good Luck

    I think in this case if you can find new employer who is willing to transfer you visa you can come back to United States. i think now you have to go for visa stamping first after your transfer approval.

    H1B Transfer Before Effective Date

    I would appreciate your response in regards to mt issue. I am employed in company A and they filed my H1B for FY 2013. It got approved on 6/15 with effective date on 10/1/12. Now other company B is offering me a job on 6/20. By the time of offer from company B H1B CAP for FY 2013 is full. My question is will I be able to file H1B through company B for this year as quota is full? Will new H1B from company B utilize same quota as previous company A approved H1B quota or it requires new visa number which is not available for FY 2013? My OPT is valid till 9/30/12 so I am keeping my work authorization valid through out entire time period. Please respond.

  15. All, I have confusion in regards to my PERM filing. I recently joined new firm where they transferred my H1B. H1B transfer was filed via regular (not premium) process. My H1B transfer is still under pending and case status is still "Initial Review". Now my question is, while my case is pending on transfer can I start PERM? Or i have to wait till my H1B transfer approves? Please advise me on that. Thanks
