My Employer has filed my perm with Dev III role though I am in Dev II. Now my PD date in EB3 is current. Attorney is saying that in order for AOS to be filed I need to be in Dev III role which means a promotion. Employer said that is going to happen any time soon. What are my options now? Can I file AOS now and when/if adjudication happens, can I use 485J with same employer? Will https://www.uscis.gov/policy-manual/volume-7-part-e-chapter-5 Job Portability after Adjustment Filing and Other AC21 Provisions - will help me in my case? i.e, portability from Dev 3 to Dev 2? I heard it is not possible but want to confirm it here. thank in advance.
