    Visa stamping not in Canada

    Hi, I have been on h1b for close to 4 years. My h1b got extended recently. I never went to H1b visa stamping before. I entered US on L2 visa and changed to H1b. I am planning to get visa stamped in Ottowa, Canada. I did my Master's in US back in 2008. I left US after 3 years and came back only 4 years ago. As I hold Indian passport, Will I face any issue going to Canada for h1b visa stamping? Thanks, Raja.

    New h1b in place of abandoned h1b

    Hi,I did my M.S. in US back in 2007 and I got h1b through h1b lottery in 2007 under STEM category. I used only 1 month of H1b and went back to my home country. I am trying to join a new company now but I cannot transfer my old H1B because it has been almost 9 years. I never entered US on this h1b so far. If the company wants to file a new h1b,1) Do I have to go through the lottery again? If yes, will it be the same procedure just like other new MS graduates next year?2) Is there a way the company can just apply for h1b now not wait for april 1st 2018? If yes, premium processing should take just 15 days, right?Thank you very much for your valuable feedback.Thanks,Raja

    L1 to H4

    Hi, My wife works on L1 and I work on non-profit H1b. My wife's maximum period of stay will expire in a few months. I want to change her visa status to H4 once it happens. Does she need to go out of US for this change? or Can I do this while she is in US? Thanks
  6. My employer's immigration company didn't file for h1b transfer saying even it is done, if USCIS figures out this error in the future, it will jeopardize my green card process. My employer also agreed with their immigration specialist that it is risky and could hurt their reputation.
  7. I want to find out if anyone converted that 90% to 100%. If yes, I want to find out what document is missing from my profile. If I can show a memo or written law or some other thing which will convince my employer, I can improve my chances.
  8. Hi, I have done MS in USA from 2006 to 2007 and I got H1b approved from 2008 to 2011 under Master's(STEM) quota. I only worked for 4 months in this visa and I went out of USA. I came back to USA in 2014, starting working using L2 EAD and got cap-exempt(non profit) H1B approved. I am currently working on this H1B visa. Recently, I got an offer from a for profit company and I wanted to transfer my old for-profit H1B to the new company. However, since it has been more than six years(from 2008), my new company's immigration specialist is saying h1b transfer is not possible. Can you please advise? PS: I have already paid for single time consultation with Murthy firm and the attorney said this shouldn't be a problem in 90% of the cases. Thank you very much, Raja

    H1B cap exempt new employer

    I did my Master's in US. My first H1B got approved in 2008 and worked for only 3 months under H1B. I returned to my home country and I didn't get my h1b stamping. Also, as I moved out of US, my employer might have revoked my H1B visa. I moved back to US in 2014 under L2 visa. A non-profit organization sponsored a new H1B for me under cap-exempt as it is non-profit educational institution. Now, I have to search for new employer as my current employer wants to downsize. My question is, Can a new for-profit employer apply for cap-exempt h1b application because I am already counted against 2008 h1b cap, even though my h1b was revoked at that time? Does it matter if my h1b is NOT revoked? Thanks a lot
