I am an Indian national, was working in the US, have an approved I-140 with Adjustment of Status (AOS), L1 visa has expired, and now I’m moving back to home country this week to work for the India branch of the same US employer. My long term wish is to come back to US with a Green Card but not necessarily when my Priority Date becomes current. Can I change the I-140 to Consular Processing (CP) while residing in India, so that I have the flexibility to choose when to move back to the US? With CP can I get the GC while I am residing in India or do I need to move to the US with an employment visa first? Thanks for helping!

Hello! I have an approved I-140 with Adjustment of Status (not Consular Processing) sponsored by my current employer, and I have worked for them for 180+ days after the I-140 approval. My L1 visa expires very soon, I will have to move out of USA, and go to my home country, India. I want to stay in India for 5 years or so for personal reasons, and after that I may want to move to a different company in the US. Will the I-140 still be active after 5 years of staying outside of US? Since the I-140 is based on AOS, can the new company file a cap-exempt H1B petition for me after 5 years? Can I change the I-140 to Consular Processing while I am in India, before I even join the new US company? Thanks!
