    Immigration Related Issues of COVID-19 Continued

    Hi Team, I am on H1B and my visa is going to max out on 30 May. Due to COVID situation I will be submitting my change of status to B-2 application to USCIS. May I know 1. Till the time I don’t get receipt/approval from USCIS on my COS application will I be considered on H1b or B2 status? 2. If I will be considered on H1 B status then will my I-140 be still continued as I have consumed all my 6 years in US? 3. In case COS gets denied then what status I will be considered in time period I spent in US ?  Thanks

    Asylum in case of Covid-19

    Hi Team, This question is regarding one of my colleague who is in US and on H1 B but he is suppose to go to India as his Visa extension got denied. He is thinking to seek for asylum as he is afraid to go back to India because of COVID. I wasnt sure if his decision is correct or not as: 1. Is it advisable to seek an asylum when you already have a non immigrant visa and lived in US for more than an year? 2. Is it going to impact GC processing? 3. How his current job will be impacted if in case his application is filed. Does he have to leave the job or take new job based on new status if asylum application is approved? 4. Any other bad impacts of Asylum Please suggest, Thanks

    I-140 premium processing on hold and visa maxing out

    I have recieved an audit on my application, means I need to go back to India by June. But due to COVID-19 I am not sure if travel to India will be safe. Will there be any provision to apply for temporary extension?
  5. Hi Team, I am from India, came to US in 2014 and I have a situation where my H1B visa is maxing out on 2 June 2020. My PERM was filed in October 2019 and I haven't received any response from DOL yet. With premium processing put on hold due to COVID-19 and with no tentative dates given when suspension will be removed what backup options I have or what should I prepare for in these remaining two months. Is it more probable that I have to go back to India? Also by what timeline I will be safe to still file my I-140 if suspension is removed. Please suggest folks. Thanks, S A
