    Best thing you can do is to apply now for her COS to H4 and EAD at the same time. She can work till the H1 expiry and when H4 and EAD are approved she can switch over to H4 and work. Her GC processing can continue while she is on H4.

    You should consult an attorney. Both options are equally bad, but there might be a way around for you if you take few precautions. Its good to talk to an attorney about those rather than a public forum.

    You can apply for visa stamping, but I dont think consulates are issuing visas now. Even if you get a visa stamped now, you can't travel till the ban is lifted.

  10. Its ok as you have filed it with a NPT. Visa status is not tied to medical insurance. You can stay as long as the petition is pending.
  11. I am assuming you work for Emp A for more than 1 year, then a 14 day notice is pretty common. After the transfer is approved give old employer a 14 day notice and you should be good to move to the new employer. If you I140 is approved for more than 180 days, new employer can port the PD.
  12. Your Max out date will still be 6/2021 unless you have a i140 from the new employer by then. Even if you have a I797 till 2022, I don't think its a good idea to stay if you dont have an i140 to back it up. You should consult an attorney.

    1. As long as your employer allows you to work remotely you can work from India. No time limit. 2. No issues on the US side, but check with a CA to see if you have to file taxes in India too.

    You should atleast have the I129 petition sent to USCIS by the last date of your grace period. Just accepting an offer doesn't mean anything. If they are not able to file in time, you should consider B2 visa. Check with the attorney and they should be able to speedup the paperwork as you have a time crunch.

    You can do it. But how will the client provide the client letter and prove that EE relationship will be satisfied when he must have given a similar letter for current employer too. Its tricky to do it when a petition is pending.

    Usually that's how it is. If you COS is pending and you apply for H1 then it will not come back with an I94 as you are waiting for other petition to put you back into status. Yes, it will take 5 months if you are lucky. If you have a valid visa, you can apply for H1 and travel to the border to go out and come back in on H1. This will invalidate the B2 and you will be on H1 when you come back in, provided the travel is an option at this time.
  24. You should wait for the consulates to open and see how they are will deal with it. Anyone's guess is good as yours. My Guess is they will allow everyone who's appointments are cancelled to reschedule their appointments. But the travel ban has to be lifted before the visa's can be issued and people can travel.
