  6. @poojB I agree with you. It doesn't matter how many times you tell them, they will still fall into the trap. With the new process USCIS made it so simple for such cases. Just $10 for applying should ring alarm bells.

    Yes, you can use the I140 for future H1 extensions with any employer. No, but your new employer should start from Perm and complete I140 to file for I485.

    You can ask you attorney to see if they can file a nunc pro tunc case for you and file for an H1 extension. May be even request for an I94 extension due the current conditions.

    Non paid period during H1B

    If your job ended on Jan 31st and your 60 days grace period starts on Jan 31st, you are good till march 30 to start the new job. Your employer will have to do a new H1 petition to hire you back to show this as a brief break in service. I am guessing your i94 is valid till beyond March.

    If you always had a cap exempt H1 and never went though the lottery, they you can't transfer from non profit to a for profit organization. You will need to go though the lottery process.

    You can reach out the local CBP office to see if they will treat this as a mistake and correct it. If not, you will either have to travel or file a new petition to get a new i94.

    Best option is apply for H4 and H4 EAD ASAP and work with EAD. Why do you want to be on H1 when you have the option of EAD? If you file for H1 while H4 COS is pending, then the order in which they get approved will determine your status. If H4 gets approved after H1, then you will have to apply for H1 again or go for stamping and come back.
