    H1B status - Grace Period Situation

    What is your I94 Expiry date? I think the best option is to apply for a COS to H4 and don't worry about the H1 from B as its of no use if you don't have a job. It will be risky to proceed further on it. Any employer can apply H1 for you if they have a valid job offer, but it will be in consular processing as you have used the 60 day grace period. You will one 60 day grace period for one petition.

    Apply for L2 and EAD and you can work on EAD once approved. Why do you want to work on H1 with all the restrictions? Once I140 is approved and you can switch to H1 anytime if there is any issue with L2 EAD.

    Yes, A will have to restart the process if you go back to them.
  6. File an extension to be safe. But leave asap and the restrictions are lifted. Don't wait for the extension to come back.

    Since you i94 is expired, you can't file for an extension of stay but will have to do a consular processing petition for which you can go for stamping in Mexico or Canada. Don't have high hopes in the B2 to be approved, just use it to stay till things get better and leave at the first available option.

You need to leave before your 60 day period ends and if you can't find a job. You can always find a new job and file a new H1 (not go thought the lottery) and come back with a new visa.

    You can do a COS depending on your I94 date. But its better to talk to an attorney and confirm.
  14. Your employer should be filing an appeal and not you as its an employers petition. If the in house attorney is not doing it, then you can work with an other attorney. Denial under specialty occupation is not about you, but the job is not complex enough to be treated as a specialty occupation.

    You can apply for new jobs and they can file for a new H1 peition, but they will have to do it under Consular processing which means you will have to get it stamped before you can start working.

  22. Why do you think A did a concurrent employment filing when you had only one job with A? Your old employer already terminated you as you are receiving severance pay. I don't think you can work for Both employers at the same time in your scenario.

    Check with an Immigration attorney as we are dealing with expired I94. 7th July 2019 was long time ago, you should have planned better.

I don't think that will be any useful as everyone is facing some issues with this virus and its not a specific case that will need an exception. 5. Since you are not in US, they will have to file it under Consular processing and not as extension of status.
