  1. Your spouse doesn't need to notify the employer of the COS. Your spouse can work on H1 till the H4 is approved and resume work once he/she receives the EAD. Mostly H4 and EAD will be approved at the same time. You will receive the approval notices and EAD card within a gap of 1 week-10 days, this is when he/she needs to stop working. You can notify the employer that you have converted to H4 after you receive the approval.
  2. Did you talk with the attorney why they filed till Aug 20th 2020 and not March 13th 2020 if that is the maxout date? They might have seen something else in your case which pushed the date to Aug 20th.

    Why do you want to put your names into the LLC? If your wife's have EAD, let them be the owners and take care of the LLC. I am assuming you are on H1 and if you get associated to the LLC, its just more paperwork showing you are not involved in the day to day operations. You might not run into any issues added you names, but I see more damage than benefit in doing so. If both are on H4-EAD's and if their EAD's are stuck in processing sometime in the future who will be the one running the operations then? Atleast on paper.

    Yes, they can withdraw your I140. But you can still use it for extensions with new employer till date is current. Have you new employer start your GC process again.

    You should get it in a few days. If you don't get it by 30 days, you should call them. One other option is to see when the check is cashed, it might have the receipt number in the back (I have heard about it, so don't quote me on it). But I would appreciate it if you can let me know if you see the receipt number on the back of the check when its cashed.

    Is there an option for you to go back to your old employer and work for him or have you burned that bridge?
  13. So your Case of status is denied and your H1 is approved. You will need to go for visa stamping and come back to work on H1. Second masters, CPT and more than 12 months...these look like the reasons your COS is denied. You should expect questions on these at the consulate.
  14. Generally a good attorney will not close your case till they receive the hard copy of the approval notice. They should support you till you get a hard copy of the approval notice.

    If you don't find anything in a week or so, start making plans to leave. You can always come back with a new employer I797 approval notice, as you have a valid visa stamp in your passport till 2022. I think @gopalakrishnach will also agree with this statement 🙂

    If getting a visa stamped till Sept 2020 is your concern, then you are ok that should not be an issue. Did you considered getting an extension approved and then go for stamping just to avoid the pain of going for stamping again after Sept 2020? Also travel while extension is in process is not recommended.
  19. I don't think that will be a problem if your employer is OK with it. Check if they are willing to file for an extension while you are in India or do they want you to be back to file for an extension. Hope your mother feels better soon!
