    Check with your immigration team/attorney if the change in Client will need an amendment to be submitted. My guess is yes, but let them decide it after reviewing the original paperwork. If they file an amendment, then you need to wait for it to be approved to go for stamping. I would not advice you to go for stamping with Client A docs. When they do verification and find that you don't have an job offer with A, they will reject your visa.

    221G for H4 asking for marriage photos- Yes, seen these cases before. But why did you not carry the photos before? Its one of the main proofs to prove you are actually married. Timeline - It should clear out in a couple of weeks.

  9. a. I think it will be fine as you are legally allowed to study while on H4. b. Mexico doesn't do status change for TCN's, but Canada does. Will there be any issues with visa interviews? No one will ever know till its done. c. Also I think you will have to maintain H4 till F1 gets approved which could take 18 months. But going for stamping is a good decision rather than waiting on COS.

    Why was the amendment denied TWO times? Consular processing might be a good option, but it will be depend on why the petition was denied previously.

    If the visa stamp in your passport is expired, then you will have to go for stamping again.

    Its illegal to stay beyond 60 days. When you file for a H1 transfer, USCIS will ask for latest paychecks and if you can't provide them you will be in trouble. Check with an attorney to see if they have any other options for you to switch to different visa class.

    You might have to check with your attorney who filed this case for you. Generally I539 will be treated as abandoned when the petitioner leaves the country. But in this case she will be back by the time the petition will be adjudicated and will have a new I94 which will not match the one you submitted when filing for the extension. She will not have any issues coming back on 3/25/20 as she has a valid visa.

    Better to call CGI for an confirmation. Will the husband not travel with his wife and the baby? I don't know if that will raise any issues.

    1. Yes, you can file for extension with B with I140 approved from A. 2. Even if A revokes you I140, you can still use it for extension as it was approved for more than 180 days.

    I am assuming her current visa is expired. She will need to go for stamping with your H1 approval notice and travel back. Her extension will be abandoned once she travels out of the country. Better to wait for her to come back and then file the amendment.
