  1. Hello, Its been almost 7 months since the Motion to Reopen for my i140 (EB1C) denial was received by USCIS. Do you all have any suggestions on what should I do? My Lawyer is suggesting refiling of my i140 but then I will lose my priority date of June 2018. Any one of you have had any successes in similar cases? Best Regards, Pallavi

    i140 denial Motion to Reopn

    Hello, I had received an RFE after my employer applied for i140. The RFE was about 'ability to pay'. My employer provided all the possible evidences and then the case was denied saying that the evidence was not received in time. We filed for motion to reopen or reconsider - 290b. The case has been open since 7 months now. When my attorney called the USCIS to find the status, USCIS said we have 'reopened' the case and are reviewing it. What should I expect after this? Is this a positive news? How long such motions take to give away the final verdict?
