  1. After realizing my I94 has been expired, I called multiple CBP offices and requested for I94 renewal. Everyone suggested me to cross the border and come back. Since I did not want to jeopardize my visa status, I filed I-539 (costly - 470$) not to have any gap (out of status period). I checked with USCIS if I can stay here with I-539 receipt to which they responded "Yes" and they also mentioned it is gonna take approx 6 months for them to issue a new I94. Today, I came to Laredo, TX (Mexico border) and explained CBP that my I94 is expired on 22nd June. They were easy on me and asked me to cross the border and come back without having to enter Mexico. While entering back to US, they've asked my I797 and stamped visa. Immediately, I could see the new I94 dates reflecting on the I94 official portal. I'm about to withdraw my I-539 as there is no use of it now. Note: CBP is considering these kind of cases because of COVID situation.

    I94 expired with valid I797

    Hi, My I94 expired yesterday and to be on the safe side, I've filed I539 requesting USCIS for extension of stay. Here are the following questions I have - 1) Since my I94 expired yesterday and I filed I539 today, What will be my visa status? 2) Can I go to Mexican border and request for I94 extension even after its expiry? Will they consider based on my I797 validity? 3) Will I be able to work with the current receipt notice (I539)? Thanks, Nish

    H1b LCA required?

    Hi, I filed H1b amendment with my current client A and it is in process. However, it appears my project is going to end soon. I have plans to move to a different client. My LCA address is Home address as I work remote with client A. Even with Client B, I will be working from home. Do I need to file an LCA in my case as there is no address change?

    With an intention that it might be useful for others, drafted all questions that were asked during the interview when a USCIS Officer visited the client place - 1) How did you find this job? 2) If at all your client wants to fire you for any reason, can he do? 3) Who would approve your leaves? 4) What is your salary? 5) Does your employer assign work to you? 6) Who is your supervisor at employer? 7) Who evaluates your performance report? 😎 What is the educational requirement for this job? 9) Describe your roles and responsibilities in detail? 10) Email conversations with employer regarding Work/Performance reports? (Luckily, i was able to divert him by showing the actual performance reports of hard copies) 11) How often you talk to your supervisor at employer? 12) Who paid your petition fee? 13) Are you paid bi-weekly or monthly? 14) What is your designation? 15) What was your interview process?

    H1B Site Visit To Old client location

    Sometimes, they contact your employer too. Same happened in my case, Client X responded that the project was completed and then they contacted my employer too. My employer clearly mentioned that we filed a new amendment and it is in process. Finally, my H1 got approved without any hassles. Wish you good luck !!

  11. Hi, Here is my situation. My H1 visa was expired on 30th Sep, 2018 but my extension was timely filed. While this is pending, i had to change the project and file amendment petition with new project and this got approved with starting date as 1st March 2019 (3 years validity). I have received RFE recently on my previous pending petition and my attorney suggested that this application can be revoked as there is no use with it. Furthermore, he suggested i can go to stamping with new approved I797 ignoring the other pending petition. Now, can i go to Visa Stamping in this situation with my new approved I797 copy? Is there a chance of 221g cause of pending petition or gap in I797 dates? Thanks, Nishanth
