  1. Hi Shadan & Omshiv, Thank you for replying. After going through several posts on this topic, I know that it is thejob description which drives the EB-2 or EB-3 category. That is the reason why I have posted the job description here. Also this is the job description for my future role. So if this job doesn't allow me to fall into the EB-2 category, I have the freedom to chose my career path going to a different role within the company which can allow me to qualify under EB-2. Cap-gap, Thanks a lot for the clarification. I just spoke to the folks in the international department in my office and they said the same thing. We may have to look into adjusting the job description or apply for a different role.
  2. Hello All, I started my GC process couple of days ago and I have a question if I qualify for EB-2 category based on the following job description of my future role: Minimum Requirements: Bachelor’s degree in product development related discipline (e.g., Engineering, Manufacturing, Marketing or Design) 5-10 years experience in concurrent product development. Skill Preferences: MBA or pertinent MS in Engineering Management, Management Science, etc.. 5 to 7 years of increasing responsibility for project and people management involving a broad range of technologies and processes. As I do not have 5 years of experience before joining, I was told that I cannot apply through EB-2 based on the experience requirement. But I do have MS & MBA degrees. Based on the above requirement, will I qualify for EB-2 category. Best Wishes

H1B to L1A: Affect on GC

Thank you for responding. While returning back to US, can I come back on L1A visa? To qualify, should I be working in India on US payroll or India payroll?
  5. Hello All, Hope you had a very good weekend! I am working full time as a Project Manager(Non-IT) in US for a multinational consumer goods company on H1B visa. I am in my 5th year on H1B and they are ready to apply for Green Card. Recently my manager has asked me to help them set up a Project Management office in India. Which means that I have to work in India for 1-2years. I am very excited about the opportunity but I have several visa related questions before taking further steps. Can you please help me with the following questions. As I am in my 5th year on H1B visa, I need to apply GC immediately and my company is ready to do that. While my GC is processing, can I work in India for 1-2years? If so, will it matter if I am in US payroll or India payroll? Once I setup office in India, I would like to come back to US. I was told that it is easy to get GC on L1A visa. To be considered for L1A visa, do I have to be in India payroll? Also will I have issues getting L1A visa as I am on H1B visa now? Can you please help me. Thanks a lot!

  8. Hi All, I am a Mechanical Engineer working full time from the last 5years. My current employer will not sponsor my green card and they advised me to start looking for jobs. I wanted to change the jobs after completing my MBA(part-time). But after graduating with MBA in Finance & Marketing, I searched for jobs but did not get a job who will apply for green card in EB-2. In the mean while I started learning SAP FICO and I am almost to the end of the training. My manager is pushing me to find a job in the next few weeks. Should I wait to get a full time offer or should I shift to consulting. Will I have stamping issues as I changed from full time to consulting? Also I am not satisfied with full time jobs as they are not in a good location and the pay is low(less than $60K). Please advice me what to do. Thanks a lot for your help!
  9. Hi All, I have been working full time from the last 5 years in an engineer role after completing my MS. I recently completed my MBA(Part-time) and I got a full time offer this week. Before accepting the offer I wanted to confirm about green card processing and they mentioned that they can apply through EB-3 as the job requirement is only bachelors + 4yrs of work experience. I have asked them if they can change the job description to add Masters degree, but they said that its not possible. Now the ball is in my court and they are pushing me to let them know if I am accepting the offer. What should I do now. Can you please suggest me any ideas that they can apply me through EB-2. FYI: I am in Manufacturing industry and it is very hard to get green card. Also I am not seeing positive results in my job search with MBA.
