  1. @SPVCan I apply for CAP exempt H1B extension once my I-140 is approved even if I exhaust 6 years on my H1?
  2. Currently I am working on H1B and about to exhaust 6 years on H1B. However I want to save some time on my H1, may be a month or two so that I can use it to get H1 extension once my I-140 is approved. My H1 expiration date is August 2019. I have applied for H4 however it is expected that it will take 6- 8 months from now to get that approved. Is there any way that I give up my H1 status before it actually expires and continue to stay in USA?
  3. I am exhausting 6 years on H1B. In order to reset H1B clock, do I have to be out of USA for consecutive 365 days? what if I go to India for 3 months, come back on H4 for 2 Months and again go back 9 months? does that count as 1 year out of USA?

    I am in the same situation. Do I have to be out of USA for consecutive 365 days? what if I apply for H4 and go back to India for 3 months, visit US on H4 visa for 2 months and then again go back for 10 months?
