No issues at all, you can transfer to the new employer. How long it took for the the H1B transfer?

    H1b Transfer( any issues)

Hi xTDx, Thanks for the reply. you mentioned it would create an issue with stamping or extension. So, I can transfer to other employer with those less pay slips right? No issues for transfer?

    H1b Transfer( any issues)

Hi, Here is my situation, h1b approved like two months ago, and my last two months pay was 500$ less per each month from the start date. LCA was 78,000, But the current pay scale was set to 72,000/12=6000(from last two months) its an human error. I figured this out recently and spoke to the employer and didn't see positive movement and he said he correct it later sometime, so I am looking to change the employer, Since to change my employer I have to to submit at least my last three months pay slips for the transfer. Does any one think that less pay in Pay slips than lCA from current company leads to h1 transfer denial or issues? Any advice is greatly valuable and appreciated.

    H1-b RFE for pay stubs

You can be without pay or job for the accrual of 180 days(including vacations or gaps or out of the country). Opt:90days, Stem: 60days. If you dont have pay slips and worked for volunteer position. You can provide evidence showing that you worked on volunteer position for your employer, like unpaid offer letter if you have or submitted to school, or letter from the employer stating that you have worked volunteer position and unpaid, Or any proofs or documentation like i983 and approval from Dso for the volounteer work. P.s: I'm not a legal consultant, please do not take it as a legal advice, the information shared by me is out of my knowledge or experience and or limited.
  5. Hi JoeF, Firstly, You been doing great job in helping people with their issues. Thanks for that. Here is my situation, h1b approved like two months ago, and my last two months pay was 500$ less per each month from the start date. LCA was 78,000, Prevailing wage is 75,000. But the current pay scale was set to 72,000/12=6000(from last two months). I figured this out recently and spoke to the employer and didn't see positive movement, so looking to change the employer, Since to change my employer I have to transfer my visa and have to submit at least my last three months pay slips. Do you see any issues with transferring the visa? since the pay slips doesn't satisfies the lca wage? Do you think that less pay than lCA from current company leads to h1 transfer denial? If so, please let me know how could I get this adjusted before transferring h1b to new employer. Any advice is greatly valuable and appreciated.
  6. Hi, Urgent Advice Needed 1. I just figured that my current pay is less than the LCA. I am looking to transfer my visa to the new employer, Would I be facing any potential issues with the transfer by having less pay in the pay slips? 2. Or Can I transfer h1b without submitting pay slips? If I can, what is the best alternative I can provide instead of pay slips? And what are the chances of getting approval? 3. How many pay slips we should submit for h1b transfer? Thanks
