  1. I got my Visa approved and stamped at India and back to The USA. July 5 : Went for Biometrics July 6 : Went for Visa Interview ------------------------------------- Interview Questions : Me - Good Morning Sir VO - Very Good morning VO - Were you Ever arrested Me - Yes Sir VO - Can you explain what happened ? Me - Told him the complete story and added that the case was dismissed and expunged VO - Do you have any court documents related to the case ? Me - Produced court disposition & expungement order . VO - what is your role in your company and how much are you paid ? Me - Answered. VO - Please tell me something about your immediate family who is along with you ? Me - Answered. VO - kept my passport and did not give any 221G or any document VO - Ok Mr.XXX , thank you but we can approve your Visa right now and had to put your through Admin processing which could take couple of weeks. Me - Thank You Sir and have a nice day. ------------------------------------- July 6 - July 16 - on AP status July 16 - Status was updated to Issued July 23 - Received my stamped passport July 29 - Back to USA ( Was sent for secondary Inspection , 20 Mins Waiting )

  4. In 2017 unfortunately being at a wrong place in right time , I got into trouble and was charged with 'Attempted Patronizing a Prostitute' charges. I did not plead guilty and went for the trail and ultimately case was dismissed (May 2018) & Expunged (Nov 2018) But when the charges were pressed on me I got email from the US consulate India that my Visa was revoked and if I wish I can apply for another Visa. When Applied for my H1b extension in July 2018 I got RFE for my 129 application about the charges on me , Responded to the RFE with all the case documents ( Final Disposition , Incident Report and Expungement Order from Court) and then after 3 weeks my 129 was approved by USCIS. So now I am planning to go to India for stamping and from all the other threads here I understand that there could be some waiting time but just being optimistic is there a chance that i am not being pulled into Administration Processing as UCSIS has already verified the documents pertaining to the charges on me and then approved my extension.

    I am not a pro. but from what I have read I understand that even PTI is considered as conviction. Also even after sealing or expungement , USCIS will always be able to see your case on the record. Please don't push the panic button , it is all over now and it cannot be undone. You should have spoke to a Immigration Attorney as you got into trouble. You will have to carry this burden for the rest of your life , but nothing to worry to much worry about. Always make sure you carry documents pertaining to your case when you travel and for anything related to Immigration.

    RFE was about the case I got into. I am not sure if USCIS does any kind of background check but in my case I am assuming that since I had a prudential revocation on my previous visa after this case , they might have seen the charges on my record. As my case was dismissed , we have responded to the RFE with court's Final Disposition , a letter from Local police authority that I was not involved in any other case and also the Notice of Expungement of my case.

    Hey, I am not an Attorney and I am sorry for the mess you got into, When my h1b extension is applied , are there chances of denial - Very less , but 221 G to check complete background If my employer becomes aware of this situation , will i loose my job - Not necessary , depends on how you handle this. I have my green card in process , perm next - will there be an impact on that - May be a query from USCIS when I go to home country will there be stamping issues - Yes but you can overcome

    7th year H1B extension after i140 approval

    Premium Processing is only being suspended for cases where there is a change in employment. For an extension like yours, you can still file premium. Even if you couldn’t use Premium you’d still be ok. As long as you file before the expiration of your current visa your work authorization would be extended for 280 days automatically while we wait for the new one to be approved.

    Thanks a lot for responding pontevecchio. Case was dismissed Outight and no bargain. Status I see on my case is 'NOLLE PROS ' Yes case was dismissed because of lack of any evidence. when you say ''the visa revocation would be illegal' - Does that mean I am into any trouble or am I not in status now ? or do you think they cannot revoke my visa ? I have a valid I94 till Dec 2018. I have not spoken to any immigration lawyer till now about the matter as I have not done anything wrong , so I was confident that judgment will be in my favour. But I will definitely Involve an Immigration lawyer if you suggest so. I am not really comfortable taking about this to an Immigration lawyer filing my H1B extension helping my employer as my employer will be aware of such humiliating charges on me though they were dismissed by court. I have gone through a lot of mental trauma almost for a 6 months because of this and now with all the fast changing policies, situation is much more frustrating. I know lot of us are facing similar situations and this forum has been of great support helping us in understanding current policies.

Otherwise I have a very clean record But when the charges were pressed on me I got email from the US consulate India that my Visa was revoked and if I wish I can apply for another Visa. I am into full time employment and my educational background suits well for my current profile, even on the scale of wages I am paid well for my location. So now my problem is my H1B is up for extension with approved I140 and my I94 expires in Dec 2018. My employer is working on the documentation now and they will hopefully file it by end of Sep 2018. Will I be having issues getting the approval on my extension? Is that necessary to let my Employer know about this, as I feel the charges on me were really humiliating.
