  1. While working for Employer A filed PERM and due to H1 transfer issues I moved to Employer B. Employer A PERM is approved and he is ready to file I-140 what are the chances getting approval on I-140 when not Employed with Employer A ? I wanted to do it in Premium Processing.

    After you switch your employer , your old employer must revoke your H1 petition. I don't think that's an option for you once you switch your employer.

  9. I don't think 240 days rule will not be applicable for transfer as long as your last i-94 is valid, beyond 240 days of your transfer filed.

    yes it is, I had a transfer issue then I spoke to Murthy Attorney and I raised the same question about 240 days . She confirmed 240 days rule is only for extension. You can also call to USCIS customer support# to confirm.

    I am not an attorney but as far as I know 240 days grace period will not be applicable for transfer cases

    60 Days Grace period on H1B Denial

    If the Employer B petition denial notices from USCIS mentions anything on maintaining status then your unlawful presence will start from the day when you receive denial notice on Employer B. When you are unlawful you can't work for any Employer you need to leave the USA If there is no question on maintaining the status on the Employer B's denial notice then 2 possibilities based on the the immigration law for grace period and the law is vague 1. Your case can be considered under grace period - Emplyer C can file your transfer , you may get H1B Approval with I-94 date - Happy Path 2. Your case can't be considered under grace period - Employer C H1B petition may get approval without I-94 then you need go out side USA and get your Visa Stamping done. In both the cases USCIS decision is final and you can work until the decision is out.
