Hello All, I need some suggestions regarding my H-1B Visa stamping issue. I have attended visa interview on 09/05/2018 and issued 221g, Waiting from 6 months for an update, I am still working from my India office. The underlying i-797A for the existing visa application is about to expire on 09/11/2019. Since we have an option to file an extension before 6 months, My employer has agreed to file an extension after 03/11/2019 ( which is 6 months before the expiry ). As i am outside the States and filed for an extension, The approval would be a i-797B ( consular processing ). My question here is can i send a copy of my i-797B to the embassy that i got my extension approved and get the new validity stamped on the Visa stamp? My attorney has updated that my visa application with existing i-797A is at final validation stage and we can expect an update by end of March or starting week of April, Can i directly send them the new i-797 B petition and passport once i get the mail to submit passport? I wanted to check if an interview is needed again ? As my current visa application is still pending, There is no change in the petitioner or the nature of work? Any suggestions are appreciated!! Hello Venakata, Did you get your visa stamped? what questionnaire did you receive from the consulate ? Were the questions related to last 15 years employer/travel/personal history similar to Form DS-5535 ? Thanks,

Hello, I've got a mail to collect the passport, There was a 221g white slip placed with a different case number. Check marked on first option " you will receive further instructions at the email address you provided ..... " The status of the Visa still shows "Administrative Processing" . I am working with an immigration attorney to respond with DS-5535. Does anybody have an idea roughly how many days does it takes for DS-5535 processing? Thanks & Regards.

Hello, Thanks for your response, I've received email today " ineligible for a nonimmigrant visa under Section 214(b) of the U.S. Immigration and Nationality Act" and asked to submit the DS-5535 to HydADMIN@state.gov at the earliest. Passport is still retained with them. I am not understanding what it means? Will the embassy reconsider to approve the visa after submitting DS-5535 ? Did anybody face this situation for visa stamping? Thanks & Regards,

Hello Gopal, I am in similar situation, had visa interview at Hyderabad consulate on Sep 5th, Straight forward questions regarding client and job duties, passport retained, VO informed there will be an Admin process for a week and you will get a mail when your visa is ready. Gave me a white slip with a 14 digit case number to check the case status ( which doesn't work) , VO check marked on " your application needs additional administrative processing before a final decision is made" . It's been almost 14 days now, status shows as Administrative processing. since you mentioned your friend had a similar situation in Hyderabad and cleared in 3-4 days, Just wanted to know when this situation occurred? is it in the recently? Hello, I had interview in Hyderabad consulate on Sep 5th, Straight forward questions regarding client and job duties, passport retained, VO informed there will be an Admin process for a week and you will get a mail when your visa is ready. Gave me a white slip with a 14 digit case number to check the case status ( which doesn't work) , VO check marked on " your application needs additional administrative processing before a final decision is made" . It's been almost 14 days now, status shows as Administrative processing. Please reply back to this chain if you receive any response. Thanks

Hello All, I’ve attended Visa interview on Sep 5th. This is my first H1B stamping after initial F1 status. Working for a reputed finance client in EVC model since last 3 years. VO Asked basic question Is this your first H1B? Have your ever been out of status? Have you worked in OPT? Are you aware of the NI rules ? Are working as FTE or with an end client? Explain the job duties? these were the questions asked and I’ve answered very confidently. VO did not check a single document and retained my passport saying there will be an admin processing for 7 days and you will receive a mail when your visa is ready. VO did not say your visa is approved ( But my passport is retained ) and have me a white slip with a 14 digit number and checked on your application needs additional admin processing before a final decision is made. Its been 14 days now, the status of my visa still shows admin processing. Anybody who has faced a similar situation?

Hello All, I came to USA in 2013 on F1 visa, completed masters in 2015 from a reputed university. Working for a good employer since last 3.5 years. H1 B approved in Oct 2016, I-140 approved with same employer in July 2017. Due to a qualifying incident that occurred in 2015, I came to know that i qualified for U, Upon a reputed attorney's suggestion applied for u-visa in March 2018, Bio-metrics done in May 2018 and waiting for Deferred Action status. ( Attorney seems to be very confident in getting my U-Visa approved ). Now, I have a need to go to my home country, Which would need H1-B visa stamping, I am confident of getting all the documents for my H1-B stamping. My question here are 1) In general does a pending visa have any effect on H1-B stamping ? 1) My U-visa is pending, Does that give an impression that i am potential immigrant? 2) If there are any question about why i applied U-Visa instead of having H1-B, what should be my answer ?
