  1. Hello, I am currently preparing a petition for O-1 visa (in the sciences). I have one question, regarding the requirement for the advisory opinion letter for this petition. In the USCIS website regarding Application Process O-1 Visa (link below), there seems to be a provision for choice between a peer group (organization) and individuals with expertise for writing this letter: This section, under the sub-header 'consultation' reads as follows: A written advisory opinion from a peer group (including labor organizations) or a person with expertise in the beneficiary’s area of ability Does it mean, one has the option to use either a letter from a professional organization or peers with expertise in the field?   2. Hello I have filed I-140/NIW and I-485 concurrently (Dec 2019); just received a notice of EAD issuance. I am thinking of changing employer while the I-140/NIW and I-485 is pending. I learned that it may be possible to move to the new job under O-visa (if the new employer petition for O-visa). Any experience with this approach and any issues I have to be aware of? Is it safer to wait until the I-140 is approved, at least? Thank you
  3. Hi J1 waiver India, yes it did. It took almost a month to show received. But they backdated the receipt date to the actual date they received the NOS. Yes my application is through no objection (Fulbright ..so not so much to hope for...)
  4. It will take about a month for NOS to show up on the DOS status update. However, they would backdate it to the date they actually received it on the record (from my experience). Wishing all the best. HAA
  5. Can I apply for both an IGA and a No Objection J1 waiver simultaneously? I have a pending NOS J1 waiver application at DOS. My employer is considering filing an IGA waiver in the coming few weeks. Do I have to withdraw my NOS application or can I apply for IGA waiver while the NOS waiver application is pending? I read somewhere that it is possible but one needs to submit a separate J-1 Waiver Recommendation Application (Data Sheet) to the U.S. State Department for each waiver sought and pay a separate processing fee. Any thoughts or experience is much appreciated. Thank you. HAA

    J1 Waiver docuements

    Hi DMM1, I could not find any information on that. Therefore, I included dependent DS2019 in my recent waiver application to be safe (you can include that as additional information). I think dependents are automatically waived if the primary individual (J1) is waived. Good luck. HAA

    No Objection Waiver Timeline

    Not sure about that. Based on I-612 instructions you should NOT file I-612 if you are applying via IGA, NOS, or Conrad..that is strange... I recently applied for NOS waiver. I have not submitted I-612....any thoughts from the forum? Thank you. HAA
  8. I have a question regarding receipt of NO Objection Statement by DOS. My DS-3035 and other documents were received by DOS and posted on the site on March 7, 2018. The NOS was mailed and received by DOS on the same day (USPS tracking shows as such) . However, the NOS is not indicated as received on the DOS waiver system. What does that mean? Is there an expected lag time between receipt of NOS and showing up on the waiver system? Any advice will be much appreciated. Thank you HAA
