PARTHIPAN

Hi , I am completing my 6 year stay in usa by 14 Dec 2017(First 3 .5 years in L1 and remaining 2.5 years in H1B). My PERM Labor was applied on July 10 which is not certified yet. If i go back to india in December will i be able to apply my H1B extension(7th year) with the existing petition once i receive my approved i140 with out new cap and travel immediately to USA with out one year cooling period.
