Hi All, I have been in US for work twice on an H1B - 2013 to 2014 - 2016 to 2018 In Aug 2017, I was arrested for DUI with (BAC .14) and after the case went on for few months in court, I plead Guilty to charges, and was convicted for DUI in May 2018. I had paid all the fines, completed classes, etc. and the case was closed with probation of 3 years and licence suspended. In June 2018, I left my then Employer A in US and traveled to India to join the new Employer B in India. Now last month, in Oct 2019, my current Employer B raised my B1 to travel to US for 4 weeks. My Bio-metrics and Visa-Interview was scheduled for 1st week of Nov 2019 in Kolkata Consulate. My Bio-metrics went perfectly fine. Next day, when I went for Visa-interview, as I had mentioned the details about my arrest & DUI in DS160 form, the interviewer asked me details about my arrest, which I shared with her and showed all the documents as well. That day she gave me the paper that said your visa is denied under section 214(b). So, I understood, that meant my visa is denied and I would have to apply for new application, if I need a visa. But after 3-4 days, I received a mail from Kolkata Consulate, which had different section details. It had the following boxes checked. - Section 212(a)(1) health-related grounds - You are eligible to apply for a waiver of the ground(s) of ineligibility. Now, I am confused, what should I do, as I am given different info over mail, and it also mentions about waiver, which I am not sure, what it means. Kindly reply, and help me what should I do next.   4. Hi All, I was arrested for DUI in Aug 2017( BAC .14) and Plead Guilty to charges so was convicted for DUI in May 2018. Around May 2018, i left my existing Employer as I found new employer and they agreed to Sponsor me for H1B, so H1B transfer was initiated. I received the approval for working with the new employer, before my conviction date in May 2018 end. I traveled to India a week after my conviction in June 2018, now I plan to go for stamping, what details should I mention in the DS160 form and what court documents I need to take during visa interview. Also, since my employer created 3 months SOW, i received 3 months approval and considering 50 days wait time in Indian embassy and 3-4 weeks time for physical examination, is it advisable to go for visa interview? thanks.. kindly reply..

    @rockersingh8 Thanks for the reply. You seriously had a good Lawyer, who was able to reduce it to Dry Reckless with BAC of 0.15. It would be great, if you could share your Court/Arraignment/Pre-trials experience as well. Did you go thru trials? Please share. I am under same situation where, my Blood Test showed BAC as 0.14. For me, I had my DUI Arrest in August 2017, and based on Blood Report BAC 0.14, the DL was suspended by DMV in start of Nov'17. Now I have my Arraignment, on 10th Jan 2018 and my attorney has asked me if I want to go for Guilty Plea or challenge the decision. She told me, it is difficult to get it reduced below DUI on record based on my BAC. Now she is saying, there is little chance of reducing, so it's up to me if I want to go for Guilty Plea, as it would close the case fast. I am not sure, what decision to take, it could take couple of more months when going for further Hearings and the result might be same. Please reply. That would definitely help in making my decision.   7. @spang09 Kindly share your experience and how was your attorney able to reduce it to Wet Reckless without DMV Suspension. For me, I had my DUI Arrest in August 2017, and based on Blood Report BAC 0.14, the DL was suspended by DMV in start of Nov'17. Now I have my Arraignment, on 10th Jan 2018 and my attorney has asked me if I want to go for Guilty Plea or challenge the decision. She told me, it is difficult to get it reduced to Wet Reckless based on my BAC. All - Please reply if possible as it would help others as well.

  9. @spang09 Thanks for the reply. This helps a lot of people. Please do share the outcome of H1b visa interview post 4th Jan. Please clarify if your BAC was 0.15 or 0.05 . This confusion arose, as I happened to come across another post where you have mentioned your BAC as 0.15. Here it is.. Thanks..
  10. @spang09 - Thanks for the reply. Thanks for sharing. Considering that your BAC was .15 and the case got reduced to Wet Wreckless, i suppose it was good outcome, as i have heard, in most cases it is given to people with BAC of .08 and close. It would be really great , if you dont mind sharing your experience with court and how it was reduced to wet wreckless, it might help other too. My case is pending too. Thanks
  11. Hi @rick.lane58 , Thanks for the reply. What does form 221g mean, and does the status refused means your visa is rejected or they need further evidence to process the visa for approval. Thanks..
  12. Has anyone in last few months(Mar 2017- Nov 2017) with recent DUI under their record (may be in an year), have gone for H1B stamping in India. Kindly share your experience. Was the visa Rejected or Approved"?
