    H1B transfer

    Hi, my new employer offered me the position in July and started my visa transfer in mid-July and decided to transfer to premium processing in end of August. I was expecting to hear from USCIS for an update by mid-Sept. But there was no update from USCIS. On further checking with attorney and USCIS, it was learnt that USCIS used the check (that was sent for premium processing for my visa transfer) for some random petition being filed by new employer. So now my visa is still under regular processing. I heard from the employer attorney that my new manager is getting anxious with the time it's taking to complete this paperwork and have me on-board. I know it's a "safe harbor" to have my visa approved before the transfer. I have never received any RFEs or declines during any of my visa applications, but there is a always a first time and times have changed now. For argument sake, if my visa transfer gets declined after my move, what are the options to keep me in status ? I have heard that my new employer can apply for a new visa immediately, so I would not stop working and have no impact since my I-94 expires in 2020. Looking for further recommendations and suggestions....Thanks guys!

    Traveling during H1-B transfer

    Hello, I'm in my 8th year of H1-B since my I-140 has been approved with my current company A. I have accepted an offer with company B, who will be starting the H1-B transfer soon under regular processing. I have a planned vacation coming up in the mid-August, where I would be traveling outside the country. I wanted to know if the H1-B transfer could impact me entering back ? Do I need to reach a certain point or milestone in the transfer process to be "safe" ?

  5. Hello, I had a question about transferring my H1-B and I-140/GC to my new company. I'm currently working for Company A, who is applying for my green card. My I-140 has been approved (Priority date of Oct 2015) and my current H1-B is extended based on my 140 being approved. I have completed 6 years already on H1 and the next 3 years is being extended on the approval of I-140. My new company B who has offered me a position, which is senior profile and also a bit different from my current profile. They will transfer my H1-B before I can start with them, however they can only start the green card process after a year which is company policy. My questions were : 1. Since my current H1-B is extended based on the 140 being approved, will that be impacted if my 140 will be withdrawn from my current employer A? 2. After a year that my green card processing starts, I understand the PERM process will need to happen from start. Will I be able to hold my Priority date of 2015 ? Or will I lose that to the green card process date of Company B ? Your help and expertise is appreciated, since this is one of the factors holding me back from accepting this position in Company B. However I have an offer for a new profile as in Information Security Principal in the same company in a nearby location office. I wanted to know how will this impact my green card processing in progress. 1. Would I need to apply for a new PERM? 2. If #1 is Yes, do I get the same PD or would I get a new PD as of the new PERM (which might be after 2018)? Any other inputs or suggestion, are always welcome that I might have not considered.

  9. We were married in India 3 years ago under the Christian Marriage Act. We were dating before that for 8 years. We have no kids yet. Last week I learnt that my wife has had an affair, where she got pregnant and now she is aborting the child. The other guy does not want to do anything with this, as he was only in for the fun ride. I am very confused what to do now....file a divorce or give her a second chance. We currently both are on our own H-1B visas (I-20 filed) and reside in the Pennsylvania state. Few questions on this - If I divorce in the USA, will that be legal and binding elsewhere, including India ? - Do I meet an attorney to get a divorce, even if this will be an uncontested divorce ? Sorry I am too emotional to think straight. Any help and assistance provided, would be truly appreciated.
