  1. Hello, As of this morning Jan 2018 Visa Bulletin, My PD's for EB3 are current. I lost my husband in 2016 and we already filed for I-485 AOS . I have my EAD and have been working on my EAD. I even filed a 204(L) , Relief for Surviving Relatives . I got an RFE and submitted my medicals in August 2017. My question is what are the documents I need to keep ready as my PD is current now . Do I need to do any prep work from my side. Please confirm. Thanks Priya
  2. Hello, My priority date is October 26th, 2006 for EB3 India. If the dates become current in the November visa bulletin, what are the documents I need to keep ready as USCIS has introduced in-person interviews. The reason for me asking is , my husband passed away. I do not have much info about all this process. The I-485 which I have is from my husband and I am a derivative of it. We got our EAD in 2008 and we have been working since then using our EAD's. Can someone please help me with the info , so that I can get ready with all the documents required. Thanks, Priya
  3. Hello Sir/madam, Let me brief you about the situation I have. I lost my husband last year ,2016. We had an EAD/AP and were working on EAD. I have now received an I-485 derivative RFE asking to establish legal presence, time period being - 'before' we applied for AoS and till now; The RFE indicates proof could be any copies of EAD / I-797 Approval Notices / I-94 copies. I have a couple of questions here. 1) As my husband is no more, what documents do I provide them? Please let me know. Being a derivative applicant of the I-485, my understanding is that it is not mandatory for me to work. It was mandatory for my husband to work to maintain status. In such a case what documents do I send in response to this RFE? Please suggest. 2) Once I respond to the RFE , is it safe to travel out of the country for family emergency? Please suggest.

  7. Hello, My PD is October -2006 for EB3-India . There are predictions that the PD may be current in the September Visa Bulletin. Can I travel out of the country as my mom is not keeping well. Please suggest. Note: I have my EAD/AP which expires in Sep 2018.
  8. I lost my husband and have a 204(L) letter written to USCIS . I have a FedEx tracking number that USCIS received the letter. I have not got any communication back from them . So, I am assuming that they have received and accepted it. My husband was the primary applicant and our I-485 was pending . We were working on our respective green card EAD's and I have a valid Advance Parole to travel outside the US. I am planning to travel to India for the first time after his demise . What all documents do I need to carry with me for my safe return. Please advise and suggest.

I wanted to know if it is safe to travel to India.I am planning to return in 3 weeks . As the primary applicant is no more and it is through my husband that the Green Card was filed ,I wanted to know if traveling to India and returning is safe ? Please let me know your thoughts at the earliest.

    My husband passed away in 2016 in USA.Our I-485 is pending . We both were working on our EAD's. I have my Green Card EAD and Advance Parole till 09/2018. As per the situation, I sent a 204 (L) letter to USCIS . I tracked the letter and got to know USCIS received it. If USCIS had an issue they would have got back to me . As I did not receive any response from USCIS, I am good. I am planning to visit India this year(2017).I wanted to know if it is safe to travel to India.I am planning to return in 3 weeks .As the primary applicant is no more and it is through my husband that the Green Card was filed ,I wanted to know if traveling to India and returning is safe ?Please let me know your thoughts . Please let me know if you need any other additional information to answer the above question.

    Husband Passed Away in USA in 2016.Need Info Please

    Dear pontevecchio, Thanks for the response and thank you for the condolences. My attorney has sent a 204(L) letter to USCIS informing the same . I have not received any response from USCIS on the same . My attorney says if USCIS had an issue they would have responded back but as they have not responded, it means they have accepted the 204(L) letter. I am still concerned if travelling to India will be OK?
