    H4 to H1 COS: Expired

    Hello All, My wife is currently in US on H4. A consultancy applied her H1 in 2016 via consular processing and is approved. They did not apply for COS as they couldn't find the job. The i797 expired in Jan 2017. We have i797 in hand. Please note she has not worked a single day in the new H1. She is still in H4. Say, she gets an opportunity in another company. a. Can we initiate a H1 transfer with the expired i797? b. Should the current company apply for COS. Get that approved and only then apply for transfer? Thanks in advance.

    H4 to H1 transfer to new employer

    Thank you aa and aa for you replies. Just to confirm, my wife is still in H4 and have not started working in new H1. What I want to know is if I can go ahead with Consular processing with COS with the new company. We still not have started the Consular processing with COS with the current company. Thanks
  3. Hello All, My wife is currently in US on H4. Our consultancy has applied for her H1 via consular processing and is approved. We have not yet applied for COS. The consultancy haven't provided the i797 to us. We the have the receipt no with us. We can see the petition as approved in USCIS site. Meanwhile she has secured a full time position in another company. Can we initiate a H1 transfer with just the receipt number? Thanks in advance.

    H4 to H1

    Hello, i have filed H1B for my wife via a consultancy who is currently on H4. The H1B is approved now. But to unforeseen circumstances I have to go to India in 2 weeks. My wifes H4 to H1 COS is not done. Can you please advice what needs to be done here so that my wife gets her H1 even if I go back to India? Thanks, shamith
