    Change JOB in EB-1B category

    I have I-140 approval from University A under the EB-1B category but can't apply I-485 due to retrogression. Now I have a better offer as Assistant Professor from University B. Do changing jobs after I-140 approval under the EB-1B category have any negative impact on future EB1-A or -B applications? Will a next USCIS officer see a job change differently? Please give your suggestions. Thank you

    Change of Employer (keep Priority dates)

    Pontevecchio: Thank you for your reply. But have additional Question: 1. I got my first H1-B in 2016 and I still have three more years to use on H1-B. So do I still need to apply the H1 petition based on approved I-140? Can I apply it independently without approved I-140? 2. Also, please let me know how I can keep my approved I-140 priority date (which is Sept 2018). Do I need to apply before joining the position or I can apply later on. Thank you for your help.
  3. Dear Friends, I have I-140 approved under the EB1-B category (Priority date Sept 2019). However, I can not apply for applying I-485 due to retrogression for India. NOW, I have a job offer from another University and I am planning to start my new position in January 2020. As my I-140 is under the EB-1B category and it is employer-specific; I cannot transfer OR keep my I-140 approval BUT I guess, I can keep my priority date? Right? If YES: Do I need to apply for new EB1-B or EB1-A before joining to a new Employer? OR Can I apply anytime after joining the new position and still keeping the priority date? Also, Can I transfer my H1-B visa and applying new EB-1B category at the same time? Please advise. It is a very important juncture of my career and I look forward on your advise and suggestions.   4. I have approved an I-140 under EB-1B and my spouse got H-4 EAD. Before apply to any job, my spouse wants to get a Career Training Program under Project For Pride Living and WIOA (Workforce Innovation and Opportunity Act) which are a Job Assistance Aid provided US Department of Labor. Recently, I heard a rumor that Trump Administration Aims to Sharply Restrict New Green Cards for Those on Public Aid. So does anybody know if my wife can get this type of training assistance or not? Does this type of training will cause any issue in further Green-card process. Please suggest.

    H-4 EAD form I-765 Question

    Hi, I would like to apply for spouse H4-EAD based on approved I-140. What should I select for "Reason for Applying" in the I-765 form? There are two relevant options: 1.a. Initial permission to accept employment. and 1.c. Renewal of my permission to accept employment. I am asking this Q because my spouse was on J2 visa before and he did part-time work for a year on J2-EAD. But now I would like to apply for H-4 EAD (based on I-140). Since this is a different category, what would be correct answer 1.a. or 1.c.? Please let me know. thank you.

    **Urgent DS160 filling for H4 stamping

    Thank you for your quick response. However, I also contacted recently to one of my friend who was on J1 (J2 spouse) and then transferred to H1B (H4 spouse) and he mentioned NO in the form. And his visa (stamped) granted. So I am bit confused now. Yes, I ask my spouse to carry all documents including the waiver certificate.
  8. Hello, My spouse (H4) planning to visit India and we are filling her DS160. I came to the US on J1 visa and spouse on J2 visa. Then we got a Waiver to fulfill the two-year foreign residence requirement. And now I got H1-B visa. There is one questions which we don't understand while filling DS160. Question is "Are you a former exchange visitor (j) who has not yet fulfilled the two year foreign residence requirement?" What should I answer to this question: No: Because I'm technically no longer required to fulfill that requirement. OR Yes: I was subject to 2 years requirement and then mention that I got a waiver and provide the waiver approval number. Please let me know ASAP. Many thanks for your help.

    Hi PoojaSingh and bobvisa, I have similar questions about my wife's (H4) stamping. In your case, H4 is visiting India without primary applicant (H1B)? If yes, is it possible, that H4 can use dropbox OR needs to face interview? please let me know. thanks
  12. Hi, We (me and spouse) recently changed our visa status when we were in U.S. Mine from J1 to H1B and spouse's J2 to H1B. Our H1B and H4 visa are valid for next two years (2019), however, our visa stamps were expired in June 2015 (originally J1 and J2 visa stamp). Now my spouse planning to visit India in October/November 2017 and come back in Dec. 2017. I can not visit this time. Do primary applicant (H1B) needs to there for visa stamping? Will there be any issue for H4 visa stamp (because H1 visa stamp is not there in my passport)? Please advise. thank you.

  14. Hi friends, This week my employer (University A - CAP Exempt) applied for premium processing. Yesterday (3/29), I checked "case status" and it was "We received a request for Premium Processing". But today (3/30) when I checked "case status" it shows "Case Was Received and A Receipt Notice Was Emailed". I am not sure if it is again gone into "Normal Processing". Please let me know. thanks for your help.

Then on Jan 6, 2017, University B applied for my H1B transfer and I received a transfer receipt and started working with University B. 1. My spouse (H4) can travel to India? or we will need to wait for H4 approval? 2. Does current visa related news/issues/rumours has an effect on visa approval, especially academic H-1B (cap exempt)? 3.
