  1. Hello Friends, My H1b Extension application is pending for more than 8 months from the Vermont center. my I-94 already expired on Nov 18 2019 and will reach 240 days on July 15, 2020. I also have valid GC- EAD/AP Card (EB2) but I did not use my GC- EAD/AP card in employment yet. I always maintain my status on H1b because I need to get married and bring my wife on H4. I cannot bring my wife on H4 if I use EAD in employment. Let's assume, I will not get my H1b approval till July 15 2020 in a regular process. So base on 240 days I cannot work on H1b after July 15. Let's say I will use my GC EAD in employment from July 16 and onward and let's assume I will get my H1b approval on July 31 2020 in regular process. that means I have used GC EAD between July16-July30 for work. Question: 1). Can I work again on H1b instead of EAD after July 31? 2). Will my H1b status still maintain when using EAD in employment while my H1b approval pending? 3). Do I eligible to bring my wife on H4 after H1b approval if I used EAD in employment between July15-July30? 4. I think Form I-9 required to work on EAD after July 15 (in case we don't get H1b approval). What about in the reverse process (EAD to H1b)? Let's say we get H1b approval on July 31. what documents required to work on H1b again? Thank you.

  3. Hi Friends, I have a few questions. Let me explain to you,My H1b expires on Nov05,2019 and I-94 expire on Nov15,2019, So right now I am working on 240 days grass period which will end on July 15 2020.I have applied H1b extension in Sep 2019, got receipt on Sep30,2109 from Nebraska center. I got another receipt in Jan 2020 that my H1b case has been moved from Nebraska to Vermont center. I don't know why USCIS moved my case. I got H1b extension RFE on March 13, 2020 from Vermont center but due to COVID19 i got actually hard copy of RFE on Apr 15, 2020. My employer response the RFE on May 22, 2020.Now I am waiting for the update from USCIS. Questions,As per this situation, My 240 days reached on july15 based on I-94 date. the premium process is closed now. i m working with a direct client of my employer which does not have any layer. if my H1b not approved by July15,2020, i have the following questions ask you. 1. Can i officially stay in USA after 240 days?2. Is it possible for my employer to file another H1b petition with the same client? so based on the new H1b receipt can i continue to work after 240 days?3. Can i transfer my H1b to another employer during the 240 days period? Can i work on a new h1b transfer receipt after 240 days period?4. what are the other alternative available that i can continue to work after 240 days with my current employer with the same client or any other client?5. do you know how soon the premium process starts for H1b extension? any approximate date or any prediction?Thanks you. Please update me on my questions.
  4. Hello Friends, I have H1b approval till Jan 20 2019. But based on project changed we filled H1b Amendment in Apr 2018 and got H1b RFE from Vermont center. The Vermont center will suspend premium processing after Sep 11 2018 for H1b Amendment. Right now I am qualified for H1b Extension too. Que 1: Is it Possible to filled my H1b RFE response in general process in Vermont center and filled H1b Extension in the premium process to Nebraska center at the same time? Is it possible to get H1b Extension approved if my previous H1b Amendment is still under process due to RFE? Thanks
  5. Hello Friends, I got RFE in my I-485 application regarding the medical exam and Supplement J form. I have applied my GC in EB2 category in Dec 2009 with Company-A. Company-A had mention SOC Code: 15-1051 which has job title 'Senior programmer analysts' in labor. The SOC 15-1051 is no longer available now as USCIS provide new SOC code 15-1121 which similar consideration with 15-1051. I have worked with Company-A around 9 years and changed the company-B two years ago. Both the company -A and Company-B are desi consulting companies. I got RFE in my I-485 application now. Company-B's lawyer prepare supplement J form with different SOC code 15-1132 which has the title "Software developer". Company-B’s lawyer mentions my duties similar to my previous employer but he did not ready to filled supplement J form with SOC code 15-1121. Lawyer said my previous employer duties are match with SOC 15-1132 instead of 15-1121 and same code(15-1132) he is used in my H1b petition now. My previous employer mention my wages $106K/year in labor and my current employer mentions my wages $140k/year. 1. Will it create any issue to get GC if we response RFE with supplement J which has different SOC code but similar duties 2. Will it create any issue to get GC if we mention wages 140K/year which is different than my previous employer wages $106K/year I will be appreciate if you can update me on this Thanks
  6. Thanks for your answer. I have still have below questions. 1. If I use AC21 to join other company based on H1b trasfer, Will my current EAD/AP valid? OR Will start the GC process again with Labor, i-140 approval ? 2. If I use AC21 to join other company based on H1b transer, Will my H1b going to extend next 3 year after expired my current h1b validity ? Thanks

I have H1b since Jun 2007 with one of the Desi consulting company in New Jersey and applied for Green card in EB2 category on 2009. I got my EAD and advance parole (AP) in 2012. I got married after get the EAD/AP and my wife came to USA on H4 visa as I am working on H1b till today. I have valid H1b till 2018 and valid EAD/AP till April 2017. My wife is 100% house wife now and she is not interested with further study or job. I am on bench period last one month and my desi consultant company terminates me next one month if I am not able to get project. I am planning to do H1b transfer to different company. I have below questions to ask you, 1. If I transfer my H1b to any new company, what is the status of my current EAD/AP which I got from my current employer? Will have to apply entire green card process again from new company? Will my EAD/AP card going to void? 2. How can I continue my green card process with new company after H1b transfer? What documents required to continue my green card process with new company? 3. I have H1b till Sep-2018 and have I-140 approved. I already passed 6 years of H1b. if I will not get my Green card till Sep-2018. Will my H1b going to extend next 3 years or not? 4. What is the use of AC21?
