Looks like even after DV classes you are convicted. In CA after one year u can expunge means your case will appear dismissed but legally u were convicted hence immigration would see the conviction. Records are not purged for expungement in CA. DV some times is considered not admissible if the maximum sentence exceeds more than a year.

did not plead guilty, did not go court my lawyer took care of everything, case dismissed after class. 1. only the case details, there was no conviction. 2. told about the issue did not go in detail.. gave court disposition and immi memo letter. 3.Yes court disposition and immi letter 4.no way to avoid delay.

Hi Was your wife fingerprinted at the station when arrested? Or was she fingerprinted anytime during the process of conviction? Did the VO ask about the arrest? Did you give the court papers to the consulate? Was there a delay in getting visa stamped?

your case did not appear to VO or POE because you were not fingerprinted when arrested.. all cases are not the same.. Congrats for getting the visa.. actually you took pre trial diversion classes to get case dismissed.. which is not a conviction for immigration.. -

Ok case was downgraded and were you convicted for township ordinance? Did you do a live scan ? What did your court documents say? When are u going for visa stamping? Where u fingerprinted in the police station all 10 fingers during booking and citation?

I don't think petty offense exception applies here.. it is saying even if the alien is arrested and not even charged and there is sufficient evidence in the police report, the alien is deemed deportable/removable. it even applies to DUI charges/conviction. -

The new law for DHS is written in a way that any legal or illegal aliens with a criminal record let it be past few years back or new which has no outcome or case dismissed/convicted/ charges reduced or convicted these cases will be closely looked upon and may be denied entry/ visas/ GC/citizenship. Immigration officials have got lot of power to deny entry/visa and for GC holders from this new order. Immigration lawyers will be able to tell more or comment on it. Reality is be prepared for the worst in coming days. Don't travel outside US -

single CIMT has petty offense exception. Hence cannot be denied entry. Th order is written in such a way that if any hit in the POE or Visa interview the applicant will have tough time to get a Visa or entry at POE. I hope deportation will not be a priority for legal aliens, but the wordings don't say legal or illegal. So it applies to all aliens regardless. -

You may get a RFE and you will need to disclose your court documents with the outcome. Shoplifiting is a CIMT and your conviction was for disturbing the peace which is not a CIMT. hence you are safe I guess. Get a recommendation from the immigration lawyer. -
You could be denied entry if you travel outside the US, but not removed if in the US. The CBP officers have discretionary powers, they can deny you entry. You are Wrong. This applies to legal illegal aliens in US who has comitted, convicted or arrested or charged with ANY criminal offense includes DUI , shoplifting or Soliciting prostitution or any misdemeanor or felony arrest. First deportation is for illegal aliens then 2nd priority are legal aliens in visas. -

If your case is dismissed without conviction or probation then you will be fine. This is scary because it says even if charged the person is removable or deported.. -
But still you may be asked about this case or incident . Be prepared with the outcome of your case and disposition from court.

Consult immigration attorney. USCIS looks for the case for which you were arrsted. later u can say convicted for disturbing peace. -
When u got arrested where u fingerprinted at the station? Did u expunge ur arrest beforr traveling outside?
