    H1b Validity

    Hi, Did you spend 6 year period in USA? if not I think you can use your period at any time. It's not about counting years from 2012 to till date instead how many years you spent in USA on H1B VISA. In summary, yes you may apply for renewal. Note: Please note that this is not a legal advise but just my opinion.
  4. Hi, I don't know I got your question but why to save one or two months from 6 years period ? Once your I-140 is approved then you are eligible to apply CAP excempt H1B and you may get upto 3 years extension. If you really want to save then you may need to out of country and get stamping on H4 and come back. Because as you said COS may take several months. Please note that this is not a legal advise but my just opinion.
  5. Hi, If you have plan to go India then you can obtain H4 visa through VISA stamping. It will be less time consuming than applying COS here. Once you return then you may apply H4EAD. Note: Please note that this is not a legal advise but just my opinion.
  6. Hi, My spouse I-140 approved recently so I applied for H4-EAD(its been 40days) and it is pending(got receipt number). However my spouse H1(and my H4 too) will be expired on 30 AUG 2019. My spouse employer planning to apply H1/H4 extension by this month end. Looks like it takes several months to get decision on H4 EAD so I don't think I will get an approval by this month end. Now: 1. Do I need reapply H4-EAD along with H1/H4 extension? If so what happens to current H4EAD application? 2. Any suggestions on this situation? Your response will be much appreciated. Thank you!.

    H1 extension denail

    Hi, Yes you may apply for H1 with valid offer at any time- it will be COS as you are on H4. H4 to H1 change. 1. If your EAD gets approved first then you can start working on it. 2. If your H1B approved first then you can work start work on it. EAD is not a status, as you already changed from H4 to H1B I believe EAD is not valid because you should be on H4 status in order to use EAD. Please note that this is not a legal advise but just my opinion.

    H1/H4 Transfer and Travel; Form i-539

    Note: Please note that this is not a legal advise but just opinion. a). Yes, you may travel and your approved H1b & pay stubs, letter from employer (offer letter) should be sufficient for stamping. b). Your wife also can be traveled though her H4 petition is pending. She better attend an interview with you and get stamped for H4 (as you have your new H1B and she may/will get VISA till your H1B expire date). She can travel back with that stamping, whatever pending I-539 application will be abended. Or Before travel she can withdraw her pending I-539 and travel to India and get stamped. c). Yes, it is advisable to attend for stamping.

    H1B dropbox eligibility

    As far as I know, drop box does not depend on how many days left on our current VISA. I think if you are going for stamping on same visa category and same location then you may eligible for drop box. Once you started filling DS160, it will let you know that you are eligible for drop box or interview. Note: Please note that this is not a legal advise but just my opinion.

    H1B Extension Query

    Hi, Here it is: 1. Upgrading to premium processing does not affect the decision however you will get decision in 15 calendar days. 2. I believe yes 240 days rule apply. 3. a. If the decision does not come with in 240 days then you need stop working but can stay in US waiting for decision. 3.b. if it gets denied you may need to leave the country asap. Note: This is not a legal advise just my opinion.

    H4 to H1 is in pending but H4 expired

    Hi I got my H1B -approved couple of days back and got I -94 attached(original notice not received yet but attorney forwarded me email which he got from USCIS saying it is approved). But when I look at that I-94 in online it is still showing H4. My questions are : 1. when will it be changed to H1 2. Can I start work meanwhile. 3.As it is still showing H1, Shall I need to my home country and get my VISA stamped and come back. 4.Will I get any problems in applying SSN?(if it sill shows H4) Thanks in advance.

    Thank for the response. I do have one more question.If I get my H1B approved then shall I need to go to US consulate in my home country for VISA stamping or Can I stay here and work as long as my VISA expires.
  15. Hi, I am on H4 visa and it expires July 2015. I have applied for COS H4 to H1 this year april and it is in pending. On the other hand my husband applied for his H1 extension and my H4 extension. Those are also in pending. What if my husband got denied on his H1 before my COS status comes? As mine is COS(from H4 to H1) Can I stay here in USA or we both should leave? Thanks, SP.
