    J1 to H1B transition with only DOS approval

    Sorry for delayed update: My employer choose to apply with just the USCIS waiver approval email. And we hoped to get the final J1 waiver approval notice before we get RFE. I got the final approval letter in mail in 3 days after my employer sent H1B premium application. We were ready to respond to an RFE, but we didnt get RFE. All went through smooth and got the H1B approval in 1 week 1 day or so.

    Recent Waiver Timeline

    Update: --> Favorable recommendation from DOS on 7th Aug, 2015. --> USCIS received I-612 from DOS on 15th Aug. They didn't respond for over 2months, and I had already entered the grace period. So I contacted local congressman, provided him a letter from my employer on how imp it was for me to be back to work. The USCIS responded within a day. --> Oct 20th 2015 : the website shows approval. I had also signed up to receive my USCIS case update on phone and email. Received the update on both. HELP HELP! My next dilemma, can i use USCIS email that is showing approval... as a proof of waiver... for my H1B-premium application? I don't know when I will get paper version of the approval. Will they send me an RFE if I use just the email?

    Update: I got favorable recommendation from DOS on 7th Aug, 2015. USCIS received I-612 from DOS on 15th Aug. They didn't respond for over 2months, and I had already entered the grace period.     Recent Waiver Timeline

    My employer could file H1B based on Dept of State (DOS) approval, but without USCIS response. However, they won't go for premium processing until I get final USCIS response. If you have DOS approval, please ask your employer to file H1B BEFORE J1 expiry date on your DS2019. As I learned recently, this will allow you a longer wait time in US (i.e. longer than the standard grace period of a month given for people on J1 visa)

    So can i apply for premium processing based on just the USCIS receipt, but without the getting the final approval? I am sorry for this sort of questions. I find it annoying that USCIS does not maintain a good record of possible senarios and associated laws online.
  7. Hello, No, my H1B is not approved yet. My grace period starts soon. I asked the same question to my immediate connection in HR - i.e. how much time do i get to pack up if I get denied by USCIS, and she said it is so much unlikely for USCIS to reject at last stage. Most denials happen at DOS stage. They have seen many cases, and they seem more positive than me. Hopefully things settle for you and me. I wonder if there is a way to expedite this process? Is there anything like premium processing on waiver decisions? I wonder if premium processing of H1 (with J1 waiver pending) could expedite the waiver decision. Hopefully if nothing else, it shouldn't cause them to simply stamp "declined" due to lack of insufficient documents!

    Can one really stay longer than one month (usual J1 grace period) once the DOS has given favorable waiver recommendation, and H1 has been filed? (of course without work)
  9. I got favorable recommendation from DOS on 7th Aug 2015. USCIS received my application on 15th Aug 2015. My employer who was willing to change from J1 to H1B filed my H1B before my J1 ends. They said, they are allowed to do that based on DOS letter. However, they also tell me that I cannot work until I receive my final letter from USCIS. I am worried about the pay and loss of project time during this wait period. They also told me that my legal wait period can be greater than a month (note: my initial information was that i can stay for a month after my J1 expires, but they deny that to be true for my current scenario) Also, what if USCIS rejects my waiver plea two months after my J1 expiry? Do i pack up and leave in a day after that, or a month after that?

  11. My employer who was willing to switch from J1 to H1B has already posted my H1B documents before my J1 waiver ends. (since I have DOS letter showing favorable recommendation, they could do that legally) However as I enter the grace period, they also told me that one month grace period no longer applies. i.e. I can stay longer until I hear acceptance or denial. Is that true? It is safe to do so? Also if I get denied after say 4 months, do I pack up and leave in a day or in a month now?

Does this mean I get more than one month of grace period? And if I do stay longer than a month as I wait for the waiver, what if my waiver gets denied? Do I pack up in a day, and leave?
  14. I got favorable recommendation from DOS on 7th Aug 2015. USCIS received my application on 15th Aug 2015. They say it can take 4 months and above to give final decision. Why me? Why are others getting it in 2 weeks, and I am stuck now for close to 2 months? Even with the grace period, I now have only a month in US.
