  1. As a H1 B holder, I want to be a part of (owner of) an multi-member (there would more than 20 members), manager-managed LLC. I would be completely passive. I won't working for this LLC, won't be receiving any salary from this LLC or won't be making any decisions for it. I think that fits the definition of a passive investor. I would be receiving schedule K-1 and I would be reporting those numbers in my personal tax filings. Do you see any potential issues with this for GC application or my current H1 status?   2. Hi, My H1-B extension application is pending with USCIS. Based on their processing times, the application may not be processed before by California Driver License expires. CA DMV issues drivers license using AB-60 (for undocumented California residents). Can I apply for CA DL renewal in DMV using the H1-B extension receipt? Should I go apply for CA DL renewal using AB 60? Would that impact my GC application in anyway? Or, should I apply for premium processing to speed up the H1-B extension processing? Your thoughts would be greatly appreciated. Thank you!
  3. I contacted the Deferred Inspections department in Los Angeles over the phone, and they mentioned that a new I-94 would be issued only if one stays in Mexico or Canada for more than 30 days. Since I stayed in Mexico only for a day, it was not considered a meaningful departure and hence a new I-94 was not issued. Thanks!
  4. We went on a 3 day cruise to Mexico in November, 2017. We departed from the port on 11/9/2017, and that date is recorded and shown in the travel history. We arrived back to US at the same port on 11/12/2017 but this date is not shown on the travel history. I-94 doesn't show this new arrival date. I-94 still shows our previous entry date into US as arrival date. I need to apply for H1 B extension. Would this be an issue? How can I correct this issue. Thank you for your suggestions.
  5. I am on H1-B visa. I am employer is a preferred vendor for a large US company. I have been working at a client location A. The client has moved to a different location B which is 11 miles away and within the same Metropolitan Statistical Area (MSA). My understanding is that H1-B amendment is not required as the move is within the MSA. Questions: 1. I am planning to visit India in the next 2 months. When I go for stamping, would there be any issue if my LCA doesn't show the current work address? 2. Should I apply for LCA with the updated work address? 3. Is there anything else that I should do to keep the records straight? Thank you for your time in providing your views.
  6. I am on H1-B visa and I have EB2 I-140 approved with priority date in July 2011. My spouse also has a separate H1-B visa and has EB2 I-140 approved with June 2011 PD. As the priority dates are not moving, we are stuck in our current jobs. Now that there is a H4-EAD option available, I would like to explore the option of converting from my H1-B to H4 (dependent for my spouse) and obtaining H4-EAD. 1. What are the risks involved in converting from H1-B to a dependent H4 and obtaining H4-EAD? 2. Would that provide more options for career progress or add more restrictions/risks? Your advise based on your knowledge or personal experience would be greatly appreciated. Thank you!

    Hi, I have I-140 approved with priority date in May, 2011; hence, I'd be eligible to apply for I-485 next month. My spouse has I-140 approved with PD in July, 2011; hence, she'd have to wait for her PD date to become current. Here are my questions related I-485 application: 1. Should I apply for I-485 and add my spouse as dependent so that she gets EAD? 2. If I add her as dependent, can she apply for her I-485 when her PD becomes current? 3. If I don't add her as dependent initially (with the hope that her PD becomes current soon), would I be able to add her anytime later? 3. Or, should each of us apply for I-485 separately without including the spouse as dependent? What is the suggested approach. Please advise the pros and cons. Thank you!
