    Final AC21 updates

    Current Scenario : My 140 was approved was not withdrawn by employer A untill 180days. I joined employer B and got H1b approval till my 6yrs validity. But Employer B did not file for 140/PERM.Employer A has withdrawn 140. Now Can i move to Employer C ? Will i get H1b transfer approved and extenstion beyond 6 yrs , by using Employer A withrawn 140 ? Final AC21 updates(https://www.govinfo.gov/content/pkg/FR-2016-11-18/pdf/2016-27540.pdf) in 2016/17 has few updated provisions in 8 CFR 205.1(a)(3)(iii)(C) and (D) AND 8 CFR 204.5(e)(2).From these updates it seems possible , but not a atornrey so need your help to clarify my understanding . Also, if a person can continue to change employer once his first 140 is approved , and no additional 140 is required till he files for 485, then how this is different from EAD itself. thanks rahul

    HI, Current Situation Me: Existing H1B 797A Starting Validity Date: 06/06/2016 Ending Validity Date: 04/10/2019 New H1B 797A Starting Validity Date: 04/11/2019 Ending Validity Date: 04/30/2020 I did travel outside India and got Visa Stamped Visa Expiry 10 April 2019. My Son: Existing H1B 797A Dependent 539 based Starting Validity Date: 06/06/2016 Ending Validity Date: 04/10/2019 New H1B 797A Starting Validity Date: 04/11/2019 Ending Validity Date: 04/30/2020 Did travel outside India and got Visa Stamped Visa Expiry 10 April 2019. My Spouse: Existing H1B 797A Dependent 539 based Starting Validity Date: 06/06/2016 Ending Validity Date: 04/10/2019 New H1B 797A Starting Validity Date: 04/11/2019 Ending Validity Date: 04/30/2020 Did travel outside India and But had Existing Visa from old employer so NO Visa Stamp Existing Visa Expiry 12 May 2018. I do have 140 with Priority date 03/17/2017. I applied for Canadian PR and got approved. As i need to complete landing formalities , i need to go out of USA.I understand they are supposed to do Automatic re-validation and not issue new i94, but saw in many forums , US immi. tend to issue new i94. So wanted to understand , if i travel before 10Apr,2019 1.Will there be a issue with issued i94 considering my visa and existing valid petition expiring 10Apr2019. 2.Will there be an issue for my wife with issued i94 considering her visa expired on 12 May 2018 and existing valid petition expiring 10Apr2019. thanks rahul
  3. HI, Need advice on my h1b immigration...was on H1B with Employer A for 6.5 yrs and had I-140(passed 180 days mark) also... Moved to Employer B, have approved 797 and they have are also in process of getting new I-140 although pending..... Can i switch to new employer C based on I-140 from Employer A......will this be considered as Cap Exempt....or do i need Employer B I-140 approved to make any move ? Does this changes if Employer A has already withdrwan I-140 ? thanks

  6. Hi All, Can you all please confirm if in the cases "I797-Petitioner name" is NOT same as "Petitioner name - on last Visa stamped"..... chances of 221g is more or not? Is there anyone who has different petitioners but got successful visa stamped using Dropbox only...no interviews...??? thanks

    H1 Transfer while H1 amendment is in progress

    Hi, I am also in the same boat...... My H1b amendment is filed under Regular processing . Can i change job (apply for h1b transfer with new employer) while amendment from current employer is still pending ?any risks ? thanks rahul
