  1. Currently I am on H1-B visa and living and working in USA. My visa is maxing out (6 years gets completed) on February 2017 and my I-140 is approved. Due to my personal situation, I have to go India immediately and work from India for at least next 1 - 2 years. Can I apply for new H1-B (cap exempt) while I staying in India using my I-140 approval? Please confirm.

    H1-B extension based on PERM certified status

    Thanks, But my question is below: Since my PERM is already certified, is it legal to file for 1 year H1-B extension based on my PERM status? And, I am still waiting for my H1-B extension to processed, Can i stay in USA with this H1-B extension receipt number after my visa expired?
  4. Currently I am on H1-B visa and my visa is getting max out on Feb 2016. My employer started my green card processing on December 2014 by applying PERM application (One year before the visa max out). I got my PERM application certified on August 2015. For some reason, my employer does not want to apply my I-140 in premium. Instead they filed my H1-B (I-129 application)extension based PERM application for seeking one year extension. Since my PERM is already certified, is it legal to file for 1 year H1-B extension based on my PERM status? And, I am still waiting for my H1-B extension to processed, Can i stay in USA with this H1-B extension receipt number after my visa expired? Also, my employer filed my I-140 application as well in regular mode on Nov 2015.

  7. Dear Sir / Madam, I am on H1-B visa. My dependents are in H4 visa. We have applied extension for myself (H1B) and for my dependents (H4) on Oct 2015. Due personal emergency my dependents went to India on January 2016 while their H4 extension application is in pending status. Since my dependents are out of country, Do I need to cancel H4 extension application? If so, Could you please let me know the procedure to do that? As I also need to go to my home country for this emergency, my employer is upgraded my H1B extension in premium mode. So, I am expecting my H1B will get extend withing 2 weeks. And, I have to go for stamping before coming to USA. Do you see any problems in getting new H4 visa stamping for my dependents based on my H1-B approval while their current H4 extension is in pending and not yet cancelled? My employer did not agree to do the H4 extension in premium as they are out of the country already. Any information will help me to proceed further. Thanks.

    Hi, Thanks for your reply. So, there is no option like "Self employed" in the primary occupation list. Shall I choose "Others" from the list and enter "SELF EMPLOYED" in the primary employer or school name field?

I am on H1 B visa and in process of filing B2 Tourist visa for my parents I got below question while filing the DS - 160. Could you please help me with it. My father is working as an Electrician and he is 62 years old. And, he is not associated/working under any organisation or school. His monthly income will vary based on number request comes from clients. Approx 8,000 to 10,000 Rs per month. But we have own house, plots(lands), fixed deposit and gold jewelries for my mother. What details should I enter into DS- 160 under the work details sections? 1. Primary Occupation - What is the option should I select - BUsiness, Not Employed or Others? 2. If I choose Business or Others - Application is asking to enter Organisation or school name. What should I enter here? Shall I enter as "Self employeed" ? 3. What is the decent amount shall I enter as monthly income? My father is labor and he do not pay any income taxes. and there is no proof for income. Does visa officer ask for proof of income? PLEASE HELP ME TO ANSWER THESE QUESTIONS. I REALLY APPRECIATE YOUR HELP HERE .
