    Just wanted to check of any experiences of TN renewal after initial denial because of approved i-130 for sibling (F4 family based green card)
  4. My brother, a US citizen, is submitting i-130 for me. both of us are above 40 and were born in India, married and have our own families. I became a Canadian citizen by naturalization and since have moved to Canada for work as a NAFTA professional. Does my brother have to submit separate i-130 for each of my kids and my spouse? Or do they become derivative beneficiaries based on the age and relationship when I have to do AoS/CP? Can I modify pending i-130 if its submitted online?

    Can I file i-485?

    I'm born asian Indian and naturalized Canadian citizen (+40 year old with family) working in the US as a NAFTA professional. My brother submitted i-130 for family based green card for sibling of US citizen. As most of you here might be familiar, the F4 priority dates to become current timelines are roughly 15 years as of now. So my questions below: 1. Am I allowed to submit my i-485 since I am already in US as soon as my i-130 is approved or should I wait for priority date to become current? 2. Does my brother have to submit separate i-130 for each of my kids and my spouse? Or do they become derivative beneficiaries based on the age and relationship when I have to do AoS/CP? 3. Can I modify pending i-130 if its submitted online incase I need to add my kids and wife?
  7. Can I still renew by TN with an approved i130 if my priority date isn't current as I am a born Indian with Canadian citizenship? Will I have to mention about my approved i-130 while renewing my TN?
  8. The first step is to file a i-130 for you by your sibling and then wait for an immigrant visa to become available when you can file i-485. Based on your country of birth the timelines will vary.....

    L1A for canadian

    HiBeing a Canadian citizen, I applied for my L1A at Port of entry by road. It was approved. I paid the fee and got the I-94 valid for 3 years. But from what I understand, the approved I-797 would be mailed to me. Does anyone have any processing timelines for the same? where can I check for the samethanks

    L1A eligibility

    I was hired by a company in US on TN1 in Oct 2015 and relocated back to Canada on work in sept 2016. Now because of lack of work in Canada, they want me to move back to US. Its only 6 months till now and I will need another 6 months for L1A eligibility. Can I go on loss of pay for remaining 6 months and then apply for L1A? Can a TN1 be converted to L1A? Or I understand that TN1 can be converted to H1B. Can the same be considered for EB1 category?

    what about the duration? Will I need 1 year? what if I visit in between? I have multiple visits not exceeding 2 -3 days at a time with a total of 15 days starting from Jun 2016. I moved to Canada in June 2016 but my payroll kept running till Aug 2016. Can my stay outside the US from Jun 2016 - Aug 2016 be counted towards my time outside the US for eligibility for L1. When do you suggest that my employer submit for my L1? Or is it possible for CoS from TN workpermit to L1A? thanks

Since then I visited 3-4 times to the US for a total of 10 days. Not the same organization was to relocate me back to the US and I'm trying to drag/delay it till I become eligible for L1. Can some someone clarify when I become eligible for L1 to move back to the USA? thanks

  18. Hi I was born in India, acquired Canadian citizenship a couple of years ago and now want to move to the USA and settle down finally. What I want to know is while working on a work permit in USA, if my brother a US citizen applies for family based GC, can I extend my work permit based on the application? I have 15+ years of experience and have B. Tech. from India. Will I be eligible for EB2? thanks Sandy
