    but what about the case got 3 yrs extension based on approved I140 from employer A (which he wil revoke sooon since joining new employer B)... can we still apply for H4 EAD as new employer visa is approved beyond 6 years based on AC21 ?

    thanks guys for the inputs. Both my H1 and wifes H4 got approved and got 3 yrs extension based on I140 from previous employer and am joining next week.

    Hi Jairichi thanks for response. I am confused... Attorney said as long as the visa is in process we are in valid status. My H1 got approved and got 3 yr extension but my wife I94/Visa expires on 04/07 .. so do you mean to say if her visa is not approved by 04/07 she is out of status ? I thought as long as we have the receipt number we can maintain the status ? Please correct me if I am wrong

    The link says However, it is necessary for either the PERM LC or I-140 to still be "alive," meaning not having received a final denial or revocation decision I140 can be revoked but I dont think there is any thing called revocation of PERM LC.. May be I am wrong ? Experts please advise so is it ok to have I140 revoked

    H1 approved but H4 is pending

    Hi Guys, My H1 and wife's H4 (transfer) to new employer was submitted on Mar 9th and Mar 20th we got RFE and laywer responded on same day. H1 got approved on 03/30 but H4 is still showing pending status. Wont the premium (15 days) function apply to H4 also??? Today is the 15th day(from RFE response of 03/20) so can I expect the approval today ? or does H4 goes into normal processig time of 2 months ? Thanks

    Hi I have I140 from previous company but I moved to a new employer. Old employer revoked my I140 but I completed my 6 years and got 3 yrs extension with new employer based on I140 from Employer A. So can I apply for H4 EAD as I completed 6 yrs in US and got H1 extension based on AC21 ??? Please advise

    there is no reason as such she came to us this month only before which they filed my H1 extension.. I am planning to submit her H4 my self tomorrow to USCIS overnight so it reaches them on Apr 1st. Please advise if I dont need to

    Hi I am waiting for approval from Employer B and then 2 weeks notice then join so it would be around Apr 3rd week by which my wifes I94 and H4 with current employer would have expired. Do you mean to say that if I dont join employer B also(worst case due to non compete or what ever) her H4 is valid and her stay is valid with Emp B H4 approval ?

  14. Hi All, My wife's I94 expires on Apr 1st and I have my H1 extension filed with current employer A and H1 transfer filed with Employer B. Please note that only Employer B filed for H4 extension of Stay(I539) but not current employer A. So can My wife stay based upon receipt of Employer B though I am currently not yet joined Employer B. OR do I need to file her H4 extn with current employer A also before her I94 expiry ? Say If I join employer B on Apr 20th her stay between Apr 1st and Apr 20th considerred legal ? Or worst case if I dont join Employer B is she Out of status from Apr 1st please aadvise

    Hi Thanks for the response. So can I join employer B any time (After maxout) though petition with Employer A is pending ?? Also I have filed H4 extension for my wife with employer B but not with current employer A. So can she stay based on Employer B's receipt though I have not yet joined Employer B. Is it consideered as legal stay or DO I need to file her extn also with employer A ? please advise
